Mr. Zimmerman, a 28-year-old Hispanic man, trailed him a bit. Then he called 911, the first of seven calls from Mr. Zimmerman and panicked neighbors that begin to flesh out the details in the death of Trayvon Martin, 17, whom Mr. Zimmerman shot. The police released the recordings to local reporters late Friday night after nearly three weeks of pressure from Trayvon?s parents and their supporters.</p><p>The 911 calls from a gated community in Sanford, north of Orlando, culminate with a faint voice in the distance crying and pleading for help. A gunshot is heard, and then silence. Mr. Zimmerman told the police that he had shot Trayvon in self-defense, after the two got into a fight and Mr. Zimmerman wound up on the ground. There have been <a title="Times article" rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.nytimes.com%2F2012%2F03%2F17%2Fus%2Fjustice-department-investigation-is-sought-in-florida-teenagers-shooting-death.html%3Fscp%3D2%26sq%3Dtrayvon%26st%3Dcse">no arrests in the case</a>. The unarmed teenager, who carried Skittles and a can of iced tea, was walking to the home of his father?s girlfriend from a convenience store.</p><p>?This guy looks like he?s up to no good or on drugs or something,? Mr. Zimmerman told dispatch, in his initial call. ?It?s raining and he?s just walking around, looking about.? Mr. Zimmerman continued: ?He?s here now just looking at all the houses. Now he?s just staring at me.? Then he added a second later: ?He?s coming to check me out. He?s got something in his hands. I don?t know what his deal is. Can you get an officer over here??</p><p>Then he got out of the car with his licensed 9-millimeter pistol, and a worried dispatcher asked: ?Are you following him? O.K., you don?t need to do that.?</p><p>At that point, Trayvon ran, and Mr. Zimmerman continued to follow. The dispatcher told him to wait for the police. A suggestion was made that Mr. Zimmerman and the police should meet by a mailbox. But then Mr. Zimmerman changed his mind. ?Actually, could you have him call me and I?ll tell him where I?m at.?</p><p>The next spate of calls came from anxious neighbors. A faint cry for help and terrified howls can be heard in the background. Neighbors said they had seen two men nearby in the dark. They reported hearing a gunshot.</p><p>?A guy yelled, ?Help! Oh, my God,? ? one man told the dispatcher. ?There is two guys in the backyard with flashlights. There is a black guy down and it looks like he?s been shot and he?s dead.?</p><p>One caller said: ?I think they?re yelling help, but I don?t know. Send someone quickly, please.?</p><p>It is not clear from the audio whether one or two shots was fired. And, with the voice muffled in the distance, it is difficult to know which of the two men is crying out for help.</p><p>The police told The Orlando Sentinel on Friday that they believed the voice crying for help was Mr. Zimmerman?s. They say that prosecutors have told them they do not have enough evidence to dispute Mr. Zimmerman?s claim that he acted in self-defense. Florida affords people who act in self-defense greater protection than most states, allowing them to take action if they have a reasonable fear that their lives are in peril. The case was turned over to the state attorney?s office last week.</p><p>?That is the circumstance we are dealing with: If we arrest, we open ourselves to a lawsuit,? Sgt. Dave Morgenstern, a spokesman with the Sanford Police Department, said. ?I would have to say I don?t think we have conducted a racially biased investigation at all.?</p><p>Sergeant Morgenstern said that Mr. Zimmerman was in contact with the police and was cooperating with the investigation. In a letter to The Orlando Sentinel last week, Mr. Zimmerman?s father said that his son had black relatives and friends and was not the aggressor in the case.</p><p>Mr. Zimmerman, who is studying criminal justice, was arrested once in 2005 on charges of battery on a police officer and resisting arrest with violence. The charges were dropped.</p><p>Trayvon had no criminal record. He was suspended from his Miami high school for 10 days in February, which is the reason he was visiting his father. The family said the suspension was not for violent or criminal behavior but for a violation of school policy.</p><p>Representative Corrine Brown, a Florida Democrat, and Sanford?s mayor, Jeff Triplett, have joined the parents? request for a Department of Justice investigation.</p><p>Trayvon?s parents say they have no doubt that it is their son?s voice pleading for his life in the background. They say they can imagine Trayvon reacting with fright or concern upon seeing a burly stranger trailing him in his car, then getting out to follow him.</p></div><p><span>?I listened to the tapes and it just broke my heart again to hear him screaming out for help and pleading for his life, and he was still murdered,? said Sybrina Fulton, Trayvon?s mother. ?There is no question in my mind that is his voice.?</span> </p>]]>

<p>The Sanford City Commission passed a vote of "no confidence" in police Chief Bill Lee Wednesday night over his handling of the Trayvon Martin shooting. Meanwhile, hundreds of demonstrators assembled a "Million Hoodie March" in New York City to call for the arrest of Martin's killer. NBC's Lilia Luciano reports. </p>&#13;

<p>The<span> </span><a>Sanford City Commission</a><span> </span>voted 3-2 that it had no confidence in Police Chief Bill Lee Jr. over his handling of the Trayvon Martin shooting Wednesday.</p>&#13;
<p>Velma Williams, the city?s only black commissioner, said she spent 15 years trying to bring together the black community and white community, and the Martin episode has taken an emotional toll.</p>&#13;
<p>?And now this. It?s a national embarrassment," she said.</p>&#13;
<p>Commissioners Patty Mahany and Randy Jones supported the police chief, who came on the job last May.</p>&#13;
<p>"I would not want to see someone tried in the court of public opinion without all the facts," Jones said.</p>&#13;
<p>Mayor Jeff Triplett sounded a similar theme, though he voted against Lee. "We only have a very small piece of the puzzle right now," he said.</p>&#13;
<p>Commissioners cannot fire Lee, as he reports to City Manager Norton Bonaparte Jr.</p>&#13;

<p>The man who fatally shot<span> </span>Miami Gardens teen Martin<span> </span>was not arrested the night of the incident because his self-defense claim ?was supported by physical evidence and testimony,? according to Lee.</p>&#13;
<p>Police were thus prohibited from arresting<span> </span>Zimmerman, 28, ?based on the facts and circumstances they had at the time,? Lee said,<span> </span>as he answered six questions about the case<span> </span>in a statement that was posted on the city's website.</p>&#13;
<p>Bonaparte released his statement in response to media attention and ?a flood of questions and strong emotions from within our community, the region and nation? about Zimmerman?s shooting of Martin, Bonaparte said.</p>&#13;

<p>Zimmerman, a neighborhood watch volunteer, shot Martin during a confrontation in a gated community in Sanford on Feb. 26. Martin was returning from a 7-Eleven to his father?s girlfriend?s home at The Retreat at Twin Lakes when the shooting happened.</p>&#13;
<p>In his explanation, Lee referred to the ?stand your ground? provisions of state law. They say that Floridians have the right ?to stand his or her ground and meet force with force, including deadly force" if they feel threatened. Lee pointed to a part of the statute that says ?the agency may not arrest the person for using force unless it determines that there is probable cause that the force that was used was unlawful.?</p>&#13;

<p>Lee said that Zimmerman has a concealed weapon permit, so he was authorized and legally able to carry the gun he used to shoot Martin as a neighborhood watch volunteer.</p>&#13;
<p>Sanford's neighborhood watch handbook, which is also posted on the city's site, says that program participants' main role is to "observe and report suspicious activities" happening in their neighborhood to police.</p>&#13;
<p>"What you will not do is get physically involved with any activity you report or apprehension of any suspicious persons. This is the job of the law enforcement agency," it says in bold.</p>&#13;
<p>On another page that spells out watch members' responsibilities, the handbook says, "Remember always that your responsibility is to report crime. Do not take any risks to prevent a crime or try to make an arrest. The responsibility for apprehending criminals belongs to the police department."</p>&#13;
<p>Zimmerman did not follow those instructions, according to police and Martin's family members and attorneys. Instead, he followed Martin on that night, disregarding a dispatcher's statement that "you don't need to do that," Lee said.</p>&#13;
<p>But that suggestion was "not a lawful order that Mr. Zimmerman would be required to follow," Lee said.</p>&#13;
<p>Martin's final phone call with his girlfriend painted a starker picture, according to Martin family attorney Benjamin Crump.</p>&#13;
<p>He said that Martin got caught in the rain, put on his hoodie and was running to take cover, and then noticed, as he told his girlfriend, that "this dude is following me."</p>&#13;
<p>She told him to be careful and run home, and he momentarily lost Zimmerman. But then he told her that Zimmerman was right behind him again, and she told him to run, Crump said.</p>&#13;
<p>"He says 'I'm not gonna run, I'm just gonna walk fast,'" Crump said.</p>&#13;
<p>The fatal confrontation that ended Martin's life happened moments later.</p>]]>

<p>The manner of death was listed as an "accident."</p>&#13;
<p>Cocaine and metabolites were identified and contributory to her death, the report said.</p>&#13;
<p>Other drugs identified in Houston's body were marijuana, alprazolam (Xanax), cyclobenzaprine (Flexeril) and diphenhydramine (Benadryl), but they "did not contribute to the death," the report said. Flexeril is a muscle relaxant, and Benadryl is an allergy medicine.</p>&#13;
<p>No trauma or foul play is suspected, the report said. The final coroner's report will be available within two weeks, the coroner's office said.</p>&#13;

 to all charges in U.S. District Court and these guilty pleas were &#13;
accepted by Judge James Graham on Tuesday, 13 March 2012. Penalties have&#13;
 not yet been determined. </p><span>&#13;

 marketed under the names, "Country Pride" and "Morning Song", as well &#13;
as "Scott's Songbird Selections" and "Scott's Wild Bird Food", which are&#13;
 collectively known as "Morning Song". These brand lines include bags of&#13;
 seed and seed mixes, suet blocks and other foods intended for wild &#13;
birds. </p><p> </p><h2 data-id="scotts-miracle-gro-added-toxic-chemicals-to-their-bird-seeds">Scotts Miracle-Gro added toxic chemicals to their bird seeds</h2><p>According to court documents, the Scotts Miracle-Gro company added the <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.guardian.co.uk%2Fenvironment%2Fpesticides" title="More from guardian.co.uk on Pesticides">pesticides</a>,&#13;
 Storcide II and Actellic? 5E, to their wild bird feeds to prevent &#13;
insects from consuming the products during storage. Neither pesticide is&#13;
 licensed by the Environmental Protection Agency (EPA) for use in bird &#13;
foods. This is in direct violation of FIFRA -- the Federal Insecticide, &#13;
Fungicide, and Rodenticide Act. </p><p>Storcide II contains the active &#13;
ingredient, chlorpyrifos-methyl, and Actellic? 5E contains the active &#13;
ingredient, pirimiphos-methyl. According to the product label attached &#13;
to Storcide II containers and Material Safety Data Sheet (MSDS) &#13;
information accompanying this pesticide, it is toxic to fish, birds and <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.guardian.co.uk%2Fenvironment%2Fwildlife" title="More from guardian.co.uk on Wildlife">wildlife</a>.&#13;
 Additionally, because the EPA requires precautionary language on labels&#13;
 for all products containing chlorpyrifos, those who worked directly &#13;
with manufacturing the birdseeds should have known that use in birdseed &#13;
was illegal, unless they were either illiterate or blind. </p><p>The &#13;
EPA's fact sheet on pirimiphos-methyl states that "<img src="http://community.thenest.com/cs/emoticons/emotion-13.gif" alt="Angel" srcset="http://community.thenest.com/cs/emoticons/emotion-13.gif 300w, http://community.thenest.com/cs/emoticons/emotion-13.gif 600w, http://community.thenest.com/cs/emoticons/emotion-13.gif 800w, http://community.thenest.com/cs/emoticons/emotion-13.gif 1200w, http://community.thenest.com/cs/emoticons/emotion-13.gif 1600w, http://community.thenest.com/cs/emoticons/emotion-13.gif 2000w, http://community.thenest.com/cs/emoticons/emotion-13.gif" sizes="100vw" />lthough &#13;
pirimiphos-methyl is highly toxic to birds and fish, these risks are not&#13;
 of concern based on the use pattern", indicating that this chemical is &#13;
not intended to be applied to anything intentionally fed to birds. </p><p>Both&#13;
 chemical toxins act as cholinesterase inhibitors that result in &#13;
overstimulation of the nervous system. Small doses of either poison &#13;
cause symptoms that include nausea, dizziness, and confusion, and higher&#13;
 doses lead to respiratory paralysis and death. </p><h2 data-id="scotts-miracle-gro-knowingly-sold-poisoned-birdseed">Scotts Miracle-Gro knowingly sold poisoned birdseed</h2><p>According&#13;
 to court documents, Scotts Miracle-Gro was warned about the toxicity of&#13;
 these chemicals by two employees. One employee, a pesticide chemist, &#13;
approached management about these dangers in the summer of 2007, whilst &#13;
the other employee, an ornithologist, notified management in the autumn &#13;
of that same year. The Scotts Miracle-Gro company ignored these warnings&#13;
 and continued to produce and distribute their poisoned birdseed &#13;
products for at least another six months, until March of 2008. </p><p>At&#13;
 the same time, a federal registrations manager employed by the Scotts &#13;
Miracle-Gro company intentionally falsified pesticide registration &#13;
documents for two other products sold by the company, "Scotts Garden &#13;
Weed Preventer &amp; Plant Food" and "Scotts Lawn Service Fertilizer &#13;
With Halts". Neither of these products were registered with the EPA and &#13;
thus, both were illegally sold to the public. When the EPA contacted the&#13;
 Scotts Miracle-Gro company asking for the required documents and &#13;
certificates, the manager then "fabricated correspondence and agency &#13;
documents ... in an effort to deceive EPA into believing it had &#13;
registered these products but lost its files", according to court &#13;
documents. The EPA then launched an investigation. </p><p>According to &#13;
court documents, the Scotts Miracle-Gro company voluntarily disclosed to&#13;
 the EPA and the USDA that they had manufactured and sold poisoned &#13;
birdseed, but discontinued doing so in March 2008. </p><p>After reading &#13;
the court documents, it is my opinion that either the company or its &#13;
employees volunteered this illegal use of chemical poisons in their &#13;
birdseed because they expected that their wrongdoing would be discovered&#13;
 during the ensuing investigation. If adding these pesticides to the &#13;
birdseed was an accident, warnings from their employees should have &#13;
caused the company to immediately stop manufacturing their poisoned &#13;
birdseed and issue a voluntary national recall of all contaminated &#13;
items. However, neither of these actions occurred. Based on that &#13;
information, one wonders whether the company would ever have voluntarily&#13;
 stopped adding poisons to their birdseed if the EPA had not stepped in &#13;
to investigate the forged documents and illegal use of pesticides in &#13;
their lawn care products?</p><p>According to court documents, Scotts &#13;
Miracle-Gro sold more than 73 million packages of these poisoned bird &#13;
foods nationwide to an unsuspecting public for a period of more than two&#13;
 years. Only 2 million of those 73 million units could be recalled. </p><p>But&#13;
 it would appear that not all sellers were aware of this product recall.&#13;
 I found one story about a San Diego county couple who lost nearly all &#13;
of their domestic aviary birds at the end of January 2010 after feeding &#13;
Scotts Miracle-Gro Morning Song Wild Bird Seed that they had recently &#13;
purchased from a local Wal-Mart [<a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Feastcountymagazine.org%2Fnode%2F2670">story</a>].&#13;
 Out of a flock numbering nearly 100 birds, only eight survived. I &#13;
mention this to illustrate how poisonous this seed is to birds, how many&#13;
 birds can die after eating just one meal of this poisoned seed, and to &#13;
show that the damages caused by these products may still be occurring. </p><h2 data-id="scotts-miracle-gro-pleads-guilty-and-proposes-a-plea-deal">Scotts Miracle-Gro pleads guilty and proposes a plea deal</h2><p>As&#13;
 part of the plea deal, the company would pay a fine of $4 million and &#13;
give an additional $500,000 to help support wildlife study and &#13;
preservation. Judge Graham has so far deferred making a decision on this&#13;
 proposed penalty, and the sentencing hearing has yet to be scheduled. &#13;
Under the law, civil violations are assessed fines of not more than &#13;
$5,000 per offense whilst criminal violations of FIFRA are assessed &#13;
fines of "not more than $50,000 per offense or imprisonment of not more &#13;
than 1 year or both". If Scotts Miracle-Gro's plea proposal is accepted &#13;
by the judge, I think it would be the maximum allowed under the law. &#13;
Further, if these penalties are accepted by the judge, this decision may&#13;
 possibly be the highest ever levied under FIFRA. According to my &#13;
sources, just the proposed $500,000 "donation" to environmental groups &#13;
is "substantial" under this law. </p><p>But it is my opinion that &#13;
neither of these penalties are substantial or severe enough. According &#13;
to my calculations, even after paying the proposed fines, the company &#13;
will have earned a profit from their sales of poisoned birdseed and lawn&#13;
 care products to an unsuspecting and trusting public. In fact, even if a&#13;
 penalty of $73 million -- merely $1 for each poisoned bird food item &#13;
sold -- was levied against the company, Scotts Miracle-Gro will probably&#13;
 still earn a profit from sales of all their illegal products. For this &#13;
reason, I view this penalty as a small slap on the wrist for the Scotts &#13;
Miracle-Gro Company, a publicly-traded company (NYSE: <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fmarkets.financialcontent.com%2Fprnews%2Fquote%3FSymbol%3DSMG">SMG</a>) with an excess of $3 billion in annual worldwide sales.</p><p>Unfortunately,&#13;
 when an entire company engages in criminal activity, imprisonment is &#13;
not normally an option. But in my opinion, the outrageously inflated &#13;
salaries paid to corporate chairman and chief executive officer (Jim &#13;
Hagedorn) and president (Barry Sanders), who were in those positions in &#13;
2008, should be justified by holding them personally and criminally &#13;
liable when the company knowingly commits criminal acts under their &#13;
leadership, since presumably, this is partially what these outsized &#13;
salaries are intended to compensate them for. </p><p>It is my hope that &#13;
the judge will ensure that the maximum fines and penalties will be &#13;
levied against the Scotts Miracle-Gro Company. This is the least that &#13;
can be done in view of this egregious betrayal of the public trust, the &#13;
damage to the environment and the terrible loss of wild birds and other &#13;
wildlife -- all due to the criminal activities of this corporate giant.</p><p>At&#13;
 this point, it is likely that the government's lawyers are feeling &#13;
pretty good about this outcome: they got an admission of criminal &#13;
liability and a record-setting monetary fine without the years of &#13;
litigation and thousands of man-hours that a prosecution would require. &#13;
Yet I can't help but wonder what millions of dead finches, sparrows, &#13;
doves, cardinals and other songbirds might say about this, if only we &#13;

<p>Nearly half of first marriages break up within 20 years, a new government study finds. With those odds, you might wonder: Would we be better off living together first?</p>&#13;
<p>The new research, part of <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.cdc.gov%2Fnchs%2F">a marriage survey</a> of 22,000 men and women, suggests times have changed from the days when living together signaled poor chances for a successful marriage later.</p>&#13;
<p>"It's not playing as big a role in predicting divorce as it used to," said Casey Copen, lead author of the study.</p>&#13;
<p>Living together before marriage has been a long-growing trend. In the late 1960s, only about 10 percent of U.S. couples moved in together first, and they ended up with higher divorce rates.</p>&#13;
<p>Today, about 60 percent of couples live together before they first marry.</p>&#13;
<p>"It's becoming so common, it's not surprising it no longer negatively affects marital stability," said Wendy Manning, co-director of the National Center for Family &amp; Marriage Research at Bowling Green State University in Ohio.</p>&#13;
<p>Researchers with the Centers for Disease Control and Prevention looked for trends in first marriages. They interviewed men and women ages 15 to 44 during the years 2006 to 2010. About 40 percent were married.</p>&#13;
<p>The study found those who were engaged and living together before the wedding were about as likely to have marriages that lasted 15 years as couples who hadn't lived together.</p>&#13;
<p>But what about the couples who were living together but weren't engaged? The new study found marriage was less likely to survive to the 10- and 15-year mark among couples who weren't engaged when they lived together findings similar to earlier research.</p>&#13;
<p>For example, for women, there was about a 60 percent likelihood a marriage would survive 15 years if the couple either hadn't lived together before the wedding or were engaged while they were sharing the same living space.</p>&#13;
<p>But if no firm marriage commitment was made while she and her boyfriend were living together, the likelihood the marriage would last 15 years fell to 53 percent. The numbers were similar for men.</p>&#13;
<p>Potential explanations include more lax attitudes about commitment, lower education levels or family histories that made these couples more pessimistic about marriage, Copen said.</p>&#13;
<p>The experience of living together before marriage is different for different people, said Richard Settersten Jr., an Oregon State University professor of human development and family science.</p>&#13;
<p>Some young people put off marriage because they're pursuing a college education and starting a career. For them, "cohabitation is a trial marriage, usually without kids, that often ends in marriage," Settersten said.</p>&#13;
<p>Others in many cases, people not on a college track move from one living-together relationship to another, some of them producing children, he said.</p>&#13;
<p>Commitment has made a difference. In interviews with some women who have been married 20 years or more after living with their spouse first, firm belief in a future together was a common theme.</p>&#13;
<p>"I sort of knew he would be part of my life long-term.... I wasn't thinking, `He's moving in with me, is he ever going to marry me?"' said Hillary Mickell, a San Francisco woman who first moved in with her husband when they were students at Boston University.</p>&#13;
<p>But this was in 1985, and she did try to hide their situation from her parents in California, sometimes telling them her beau answered the phone because there had been a snowstorm and he was stuck in her apartment. "It became a running joke there are blizzards in Boston nine months a year," said Mickell, co-founder of a social network site for recipe exchanges.</p>&#13;
<p>The CDC study also concluded:</p>&#13;
<p>Nearly half of first marriages will break up within 20 years a statistic identical to what other studies have found.</p>&#13;
<p>The percentage of young women currently living with a male partner grew from 3 percent in 1982 to 11 percent recently.</p>&#13;
<p>Women and men with bachelor's degrees were more likely to delay marriage but also more likely to eventually get married and stayed married for at least 20 years.</p>&#13;
<p>Asian women were the most likely to be in a first marriage that lasted at least 20 years. Nearly 70 percent of Asian women were still in their first marriage, compared to 54 percent of white women, 53 percent of Hispanic women and 37 percent of black women.</p>&#13;
<p>Among men, 62 percent of Hispanics were still in their first marriage at 20 years, compared to 54 percent of whites and 53 percent of blacks. The study did not have statistics for Asian men.</p>]]>

<p>The Religious Viewpoints Antidiscrimination Act?s main sponsor, Rep. Andy Holt, R-Dresden, said he feels the legislation would alleviate school districts? fear of allowing such expressions. His bill is slated for hearings in House and Senate subcommittees next week.</p>&#13;
<p>?We live in a society that?s hypersensitive to statements of faith, and so I think in many ways, <a href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.tennessean.com%2Farticle%2F20120322%2FNEWS0201%2F303220018%2FBill-purports-protect-schools-when-students-pray-express-faith%3Fodyssey%3Dtab|topnews|text|FRONTPAGE#" rel="nofollow"><span>students</span></a> have been disincentivized to make statements of faith,? he said.</p>&#13;
<p>The right of students to pray or make other expressions of faith has long been upheld in the courts. But three Middle Tennessee districts ran afoul of federal law in recent years over allowing parents or outside groups to promote religion on <a href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.tennessean.com%2Farticle%2F20120322%2FNEWS0201%2F303220018%2FBill-purports-protect-schools-when-students-pray-express-faith%3Fodyssey%3Dtab|topnews|text|FRONTPAGE#" rel="nofollow"><span>campus</span></a>.</p>&#13;
<p>Sumner County <a href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.tennessean.com%2Farticle%2F20120322%2FNEWS0201%2F303220018%2FBill-purports-protect-schools-when-students-pray-express-faith%3Fodyssey%3Dtab|topnews|text|FRONTPAGE#" rel="nofollow"><span>Schools</span></a> allowed teacher-led prayer, Cheatham County allowed prayers at football games, and Wilson County allowed parents to hand out notes to students saying they were the subjects of prayer. All three allowed outside groups to distribute Bibles. <a title="" rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.tennessean.com%2Farticle%2F20120311%2FGALLATIN01%2F303110026%2FPending-bills-would-no-effect-ACLU-agreement">All three also lost or settled the lawsuits.</a></p>&#13;
<p>On its website, the ACLU said Holt?s bill is neither necessary nor constitutional and would subject students to unwanted proselytizing, prayer and preaching and open districts to violating constitutional guarantees.</p>&#13;
<p>The legislation would require school districts to implement a policy to create a ?limited public forum? before campus events such as the beginning of a school day or before a football game. Select students would be eligible to speak freely at these forums, including about religion, and the school district would issue a disclaimer before those speeches.</p>&#13;
<p>?I think the free expression of religion extends to those who may be in the public institution of education,? Holt said. ?I do believe in the freedom of religion, but I do not believe in the freedom from religion.?</p>&#13;
<h3 data-id="faith-based-answers">Faith-based answers</h3>&#13;
<p>Under the bill, school districts also would require teachers to treat a student?s faith-based answers to school assignments the same as secular answers. But while the bill allows faith-based answers, those responses must be justified like any other student?s.</p>&#13;
<p>?This is not a bill that is intended to give special advantages to those who hold a particular faith. This is to protect those who have a particular faith,? Holt said.</p>&#13;
<p>Holt couldn?t cite cases in Tennessee involving that particular type of discrimination against students.</p>&#13;
<p>Olivia Brown, a spokeswoman for Metro Nashville <a href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.tennessean.com%2Farticle%2F20120322%2FNEWS0201%2F303220018%2FBill-purports-protect-schools-when-students-pray-express-faith%3Fodyssey%3Dtab|topnews|text|FRONTPAGE#" rel="nofollow"><span>Public</span><span> </span><span>Schools</span></a>, says she?s unaware of any such problems in that school district.</p>&#13;
<p>The Tennessee bill, HB 3616 or SB3632, like ones considered in several states and vetoed in Oklahoma, is nearly a word-for-word copy of the Texas legislation that stirred controversy in that state and beyond after it passed in 2007.</p>&#13;
<p>The ACLU chapter said the First Amendment does more than enough to meet students? needs. That?s also the stance of Americans United for Separation of Church and State.</p>&#13;
<p>Joe Conn, the group?s communication director, said the bill is so broad, it could result in violating the Constitution.</p>&#13;
<p>?You don?t want to have a captive audience listening to a prayer they don?t want to hear,? Conn said.</p></div></div></div></div>]]>

        <description><![CDATA[<p>This is about the 20week abortion ban, which is "justified" by the "fact" that fetuses feel pain that early.  That was a claim made in the 1980s movie silent scream and basically has zero evidence.</p><p>Under House Bill 954, almost all abortions later than 20 weeks, including those involving rape and incest, would be banned under the premise that after 20 weeks a fetus is capable of feeling pain. Dott and two other obstetricians, also specialists in high-risk pregnancies, told the panel that overwhelming medical evidence has established that a fetus does not develop the capacity to feel pain until the 28th week of gestation. When doctors operate on fetuses younger than 28 weeks, the committee was told, it is standard medical practice not to use anesthetic because the neural connections needed to feel pain simply do not exist.</p><p><span>Yet the sponsor of the bill, state Rep. Doug McKillip, summarily dismissed the threshold of 28 weeks. ?Does anybody believe that? Absolutely not,? he told the panel, in effect calling the medical experts liars. ?They are just looking for a reason to say no to this bill.?</span> ...</p><p>[Dott] <span>told the panel, ?I have never seen a patient who electively aborted a normal pregnancy greater than 20 weeks.?</span></p><p><span>McKillip blithely dismissed that claim as well. <p><em>When confronted by an armed individual, assume that this person &#13;
is the police. As such, begin by placing your hands behind your head, &#13;
fingers interlaced. This will assure that in the eventuality that you &#13;
are shot and executed, there will be minimum opportunity for analysts &#13;
and pundits to later ponder if you were the aggressor. Keeping your &#13;

comfort to your mother and I as we cope through your loss, and so I ask &#13;

<p><em>Be clear and concise in your cries for help. This will not in any&#13;
 way add to the chance that you will survive the encounter. Instead, it &#13;
serves to ensure that bystanders and anyone recording just the audio of &#13;
the encounter will have a clearer depiction of what is happening. &#13;
Phrases such as "help me!" are not enough. You must be clear. "Please do&#13;
 not shoot me! I am just a kid!" will alert others to the fact that it &#13;
is you that is about to be shot, rather than your assailant. "I do NOT &#13;
have a weapon! Please don't shoot me!" further emphasizes that you are &#13;

In arguing for this bill Representative Terry England described his empathy for <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fthinkprogress.org%2Fhealth%2F2012%2F03%2F12%2F442637%2Fgeorgia-rep-compares-women-to-animals%2F%3Fmobile%3Dnc">pregnant cows and pigs</a> in the same situation.I have a question for Terry England, Sam Brownback, Rick Santorum, Rick Perry and too many others: I have three daughters, two of them twins. If one of my twins had been stillborn would you have made me carry her to term, thereby endangering both the other twin and me? Or, would you have insisted that the state order a mandatory fetal extraction of the living twin fetus from my womb so that I could continue to carry the stillborn one to term and possibly die myself? My family is curious and since you believe my uterus is your public property, I am, too.Mr. England, unlike the calves and pigs for which you expressed so much empathy, I am not a beast of burden. <strong>I am a woman and I have these human rights</strong>:The right to life.The right to privacy.The right to freedom.The right to bodily integrity.The right to decide when and how I reproduce.Mr. England, you and your friends do not get to trade these rights, while "dog and hog hunting," in return for a <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fvimeo.com%2F38048437">young man's chickens</a>.My human rights outweigh any you or the state corruptly and cynically seek to assign to a mass of dividing cells that will eventually turn into a 'natural' person. Just because you cannot get pregnant does not mean that I do not have rights when I <em>am</em> pregnant. I have responsibility but am powerless. I know how it feels to be pregnant. You do not. I know what happens to a fetus in a womb. You do not. I have carried three fetuses to term. You have not. What I experience when I am pregnant is not empathy. It is permeability. The fetus is me. And the state is you, apparently. But, no matter what you say or do I have fundamental human rights. What makes you think that you, who cannot have this fully human experience, can tell me anything about gestation or how I experience it?<strong>Especially when you compare my existence and experience to that of brutish animals.</strong>The rest of the civilized world thinks this country <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.thedailybeast.com%2Farticles%2F2012%2F03%2F09%2Fnobel-winner-gbowee-asks-where-are-the-angry-american-women.html%23body_text5">has lost its mind</a>. It's no wonder. Look at this list of frenzied misogyny:<strong>1.	Making women carry still-born fetuses to full term because cows and pigs do. </strong>This week, Mr England, you supported a bill, the net effect of which, taken tandem with other restrictions, will result in doctors and women being <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.ajc.com%2Fnews%2Fgeorgia-government%2Fgeorgia-house-passes-fetal-1367649.html">unable to make</a> private, medically-based, critical care decisions and some women being effectively forced to carry their dead or dying fetuses. Women are different from farm animals, Mr. England, and this bill, requiring a woman to carry a dead or dying fetus is inhumane and unethical. By forcing a woman to do this, you are violating her right not to be subjected to inhuman treatment and tortured. And, yes, involuntarily carrying a dead fetus to term, although not torture to you or to a pig, is torture for a woman. It is also a violation of her bodily integrity and a threat to her life and as such violates her right to life.<strong>2. Consigning women to death to save a fetus.</strong> Abortions save women's lives.<a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.ibtimes.com%2Farticles%2F230846%2F20111013%2Fprotect-life-act-house-advances-anti-abortion-bill-nancy-pelosi.htm%3Fcid%3D2">"Let women die"</a> bills are happening all over the country. There is no simple or pretty way to put this. Every day, all over the world, women die because they do not have access to safe abortions. Yet, here we are, returning to the dark ages of maternal sacrifice. Do really have to type this sentence: this is a violation of women's fundamental right to life.<strong>3. Criminalizing pregnancy and miscarriages and arresting, imprisoning and charging women</strong> who miscarry with murder, like <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.guardian.co.uk%2Fworld%2F2011%2Fjun%2F24%2Famerica-pregnant-women-murder-charges">Rennie Gibbs</a>in Mississippi or at least 40 other similar cases in Alabama or like <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.thenation.com%2Farticle%2F166664%2Fprotect-pregnant-women-free-bei-bei-shuai">Bei Bei Shuai,</a> a woman who is now imprisoned, is charged with murder after trying to commit suicide while pregnant. Pregnant women are becoming a special class subject to "special" laws that infringe on their fundamental rights.<strong>4. Forcing women to undergo involuntary vaginal penetration (otherwise called rape) </strong>with <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.rhrealitycheck.org%2Farticle%2F2012%2F02%2F15%2Fgovernment-sanctioned-rape-in-state-virginia-and-texas">a condom-covered, six- to eight-inch ultrasound probe</a>. <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.addictinginfo.org%2F2012%2F03%2F12%2Fpennsylvania-anti-abortion-bill-would-mandate-transvaginal-ultrasound%2F">Pennsylvania</a> is currently considering that option along with 11 other states. Trans-vaginal ultrasounds undertaken without a woman's consent are rape according to the legal definition of the word. This violates a woman's bodily integrity and also constitutes torture when used, as states are suggesting, as a form of control and oppression. Women have the right not to be raped by the state.<strong>5. Disabling women or sacrificing their lives</strong> by either withholding medical treatment or forcing women to undergo involuntary medical procedures. We impose an unequal obligation on women to sacrifice their bodily integrity for another. For example, as in <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Freproductiverights.org%2Fen%2Fcase%2Ftysiac-v-poland"><em>Tysiac v. Poland</em></a>, in which a mother of two, became blind after her doctor refused to perform an abortion that she wanted that would have halted the course of a degenerative eye disease. If my newborn baby is in need of a kidney and you have a spare matching one, can I enact legislation that says the state can take yours and give it to her? No. We do not force people to donate their organs to benefit others, even those who have already been born. One of the most fundamental of all human rights is that humans be treated equally before the law. Denying a woman this right is a violation of her equal right to this protection.<strong>6. Giving zygotes "personhood" rights while systematically stripping women of their fundamental rights. </strong>There is too much to say about the danger of personhood ideas creeping into health policy to do it here. But, consider <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.rhrealitycheck.org%2Farticle%2F2012%2F02%2F14%2Fwhat-do-artificial-wombs-mean-women">what happens to a woman whose womb is not considered the "best" environment for a gestating fetus in a world of personhood</a>-for-zygote legislation: who decides the best environment -- the state, her insurance company, her employer, her rapist who decides he really, really wants to be a father? Anyone but a woman.<strong>7. Inhibiting, humiliating and punishing women for their choices to have an abortion for any reason</strong> by levying taxes specifically on abortion, including abortions sought by <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.huffingtonpost.com%2F2012%2F02%2F06%2Fkansas-anti-abortion-bill_n_1258185.html">rape victims</a> to end their involuntary insemination, imposing restrictive requirements like 24 hour wait periods and <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.slate.com%2Fblogs%2Fxx_factor%2F2012%2F03%2F09%2Farizona_senate_approves_bill_allowing_anti_abortion_doctors_to_mislead_patients.html">empowering doctors</a> to lie to female patients about their fetuses in order to avoid prosecution. In Arizona, Kansas, Texas, Virginia, Colorado, Arkansas and other states around the country bills that make women "pay" for their choices are abounding.<strong>8. Allowing employers to delve into women's private lives and only pay for insurance when they agree, for religious reasons, with how she choses to use birth control. </strong>In <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.statepress.com%2F2012%2F03%2F12%2Fsenate-judiciary-committee-endorses-controversial-contraceptive-bill%2F">Arizona</a>, which introduced such a bill this week, this means covering payment for birth control as a benefit only when a woman has proven that she will not use it to control her own reproduction (ie. as birth control). As much as I am worried about women and families in Arizona though, I am more worried about those in Alabama. So, what if they decide that an employee involved in an interracial marriage should not, by divine mandate, reproduce? Do they switch and provide birth control for this employee? Do they make contraception a necessary term of employment for people in interracial marriages? This violates a woman's right to privacy. My womb is one million times more private than your bedrooms, gentlemen.<strong>9. Sacrificing women's overall health</strong>and the well-being of their families in order to stop them from exercising their fundamental human right to control their own bodies and reproduction. <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.rhrealitycheck.org%2Farticle%2F2012%2F03%2F13%2Fgoodbye-texas-womens-health-program">Texas</a> just did that when it turned down $35million dollars in federal funds thereby ensuring that 300,000 low-income and uninsured Texas women will have no or greatly-reduced access to basic preventive and reproductive health care.<strong>10. Depriving women of their ability to earn a living and support themselves and their families. </strong>Bills, like this one in<a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.huffingtonpost.com%2Fstephanie-schriock%2Farizona-birth-control_b_1346146.html">Arizona</a>, allow employers to fire women for using contraception. Women like <a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.nytimes.com%2F2012%2F01%2F31%2Fopinion%2Fpregnant-and-pushed-out-of-a-job.html">these are being fired for not</a>.You presume to consign my daughters and yours to function as reproductive animals.<strong>This is about sex and property, not life and morality.</strong> Sex because when women have sex and want to control their reproduction that threatens powerful social structures that rely on patriarchal access to and control over women as reproductive engines. Which brings us to property: control of reproduction was vital when the agricultural revolution took place and we, as a species, stopped meandering around plains in search of food. Reproduction and control of it ensured that a man could possess and consolidate wealth-building and food-producing land and then make sure it wasn't disaggregated by passing it on to one son he knew was his -- largely by claiming a woman and her gestation capability as property, too.<strong>This is not about freedom of religion. </strong>If it were, we would, for example, allow Christian Scientists to refuse to pay for coverage of life-saving blood transfusions for employees. Religious freedom means I get to chose whether or not to be religious and if so, how. It does not mean that I get to impose my religion on others. Paying for insurance is part of the way we compensate employees, even when they use their insurance in ways we don't agree with and are in contravention of our own personal beliefs. I think that it is stupid, dangerous and immoral to chain smoke, especially around children whose lungs it irreparably harms. But, I still have to pay for an employee to have access to lung scans, nicotine patches and oxygen tanks. I do not get to say that my religious beliefs, which include keeping bodies as healthy as possible, make it possible for me to withhold payment of this employee's insurance. Guaranteed coverage of contraception and reproductive health care has<a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fthinkprogress.org%2Fhealth%2F2012%2F02%2F16%2F426605%2F5-reasons-why-the-contraceptive-coverage-guarantee-is-so-important%2F">overwhelming benefits</a> for society, including reducing unwanted pregnancies and abortions. By inserting your religious beliefs so egregiously into government legislation and my life, you are imposing your religious beliefs on me. You don't like mandated insurance coverage for basic reproductive health humans with two X chromosomes? I don't like being bred by state compulsion like Mr. England's farm animals. <strong>I have a MORAL OBJECTION to being treated like an animal and not a human. </strong>You do not have to use contraception, you do not have to use birth control. <strong>But, that does not mean you have any right to tell me that I cannot if I chose.</strong> <strong>That is my right.</strong>Property, control, sex, reproduction, morality, defining what is human. Sounds a lot like issues surrounding slavery 170 years ago. These laws are not about "personhood" but "humanity." That women of color are massively, disproportionately affected by these assaults on their bodies and rights should also come as no surprise - their rights and their bodies have always been the most vulnerable assault.This is about keeping women's wombs public and in other people's control -- the exact opposite of private and in their own control.And, yes, I do know how complicated the ethics, bioethics and legal arguments related to these decisions are. You, apparently, do not. If you were truly concerned with sustaining life and improving its quality or in protecting innocent children, you would begin by having compassion and empathy for living, born people that require and deserve your attention. You feed them, educate them, lift them from poverty and misery. You do not compound these problems as you are with twisted interpretations of divine will. Most of that anger is focused on the fact that the confessed shooter, 28-year-old George Zimmerman, who has been described as both Latino and white, has not been arrested.<br /><br />Dozens of Sanford residents gathered in the Sanford City Hall, where City Commissioner Mark McCarty set the tone for the meeting by noting that he had called for Police Chief Bill Lee?s ouster 10 days earlier in a meeting with the city manager, Norton N. Bonaparte Jr.<br /><br />?I take no pleasure in publicly flogging our police chief. He?s a good man,? McCarty said.<br /><br />But McCarty said questions surrounding the case, and the negative publicity cast upon the city since the killing, were largely the result of mishandling of the investigation. The questions, he said, include whether police were too quick to accept Zimmerman?s claim that he fired in self-defense, despite the fact that Martin was unarmed and that witnesses described hearing someone wailing for help before a gunshot rang out.<br /><br />A lawyer representing Martin's family, Benjamin Crump, has said that the teenager was on a cellphone with his girlfriend and expressed concern that he was being followed by a strange man in the seconds before he was shot. And two women who live near the shooting scene have said that Martin was lying face-down, with Zimmerman looming over him, after he was shot. <br /><br />?If it was self-defense, why was he [Zimmerman] on Trayvon?s back?? one of the witnesses, Mary Cutcher, told <a title="CNN (tv network)" rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.latimes.com%2Ftopic%2Feconomy-business-finance%2Fmedia-industry%2Fnews-agency%2Fcnn-%2528tv-network%2529-ORCRP000008070.topic">CNN</a> in an interview.<br /><br />City Commissioners Patty Mahany and Randy Jones argued against the no-confidence vote, saying the city needed to wait for the outcomes of a grand jury inquiry scheduled for April 10 and a Department of Justice investigation.  ?A rush to judgment in any situation is wrong,? said Mahany, calling the no-confidence motion a ?knee-jerk reaction.?<br /><br />Only the city manager, Bonaparte, can fire Lee or ask for his resignation, and he gave no indication he planned to do so.  But as speaker after speaker, black and white, took to the microphone to question why Zimmerman had not been arrested, it was clear that Bonaparte faced pressure that showed no sign of diminishing.<br /><br />The Rev. Al Sharpton was due to lead a rally in Sanford on Thursday, and the city was planning for hundreds and possibly thousands of people at a special meeting Monday night to focus on the case.<br /><br />In Manhattan?s Union Square, hundreds of people marched in memory of the slain teenager in a so-called Million Hoodie March on Wednesday, including Martin?s parents. Martin was wearing a hooded sweatshirt when he was killed while walking back from a store where he had purchased some candy and a drink.<br /><br />"We're not going to stop until we get justice," said the teenager's father, Tracy Martin, after thanking the crowd in New York, which chanted, "We want arrests," according to the Associated Press.<br /><br />"My son did not deserve to die," the teen's mother, Sybrina Fulton, told the crowd, AP reported. "My heart is in pain, but to see the support of all of you really makes a difference."<br /><br />More than a dozen people spoke at the Sanford meeting, the overwhelming majority of them black city residents complaining that the Police Department was quick to arrest blacks while letting whites accused of similar offenses go free. <p>Filled with language about ?government-owned equipment? and a ?defense executive reserve,? among other vague statements, rumors began to spread that the executive order expanded the president?s power to do everything from seizing whole industries to drafting private armies.</p>&#13;
<p>A Canada Free Press article titled ?Obama Executive Order: Peacetime Martial Law!? spread concerns of gasoline ration cards; while an Examiner article declared the order would ?nationalize everything? and ?allow for a civilian draft.? Facebook, email and Twitter were suddenly abuzz, and even the extremely popular Drudge Report posted a link to the White House release under the title ?Martial Law? Obama Issues Executive Order.?</p>&#13;
<p><strong>But are the cries of martial law and expanding executive power justified?</strong></p>&#13;
<p><strong>No, says William A. Jacobson, associate clinical professor at Cornell Law School.</strong></p>&#13;
<p><strong>?If someone wants to make the argument that this is an expansion of presidential powers, then do so based on actual language,? warns Jacobson. ?There is enough that Obama actually does wrong without creating claims which do not hold up to scrutiny.?</strong></p>&#13;
<p><strong>As it turns out, Obama?s executive order is nearly identical to </strong><a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fwww.archives.gov%2Ffederal-register%2Fexecutive-orders%2Fpdf%2F12919.pdf"><strong>EO 12919</strong></a><strong>, issued by President Clinton on June 7, 1994, which itself was an amendment to EO 10789, issued in 1958 by President Eisenhower, and which in fact, was later amended by EO 13286, issued in 2003 by George W. Bush.</strong></p>&#13;
<p>Obama?s executive order specifically assigns ?executive departments and agencies responsible for plans and programs related to national defense? to do five things:</p>&#13;
<ul><li>?identify? requirements for emergencies;</li>&#13;
<li>?assess? the capability of the country?s industrial and technological base;</li>&#13;
<li>?be prepared? to ensure the availability of critical resources in time of national threat;</li>&#13;
<li>?improve the efficiency? of the industrial base to support national defense;</li>&#13;
<li>?foster cooperation? between commercial and defense sectors.</li></ul><p>Later provisions in the order establish the protocol for government agencies to purchase equipment needed in times of national emergency and even make loans to ensure the availability of that equipment.</p>&#13;
<p>Despite the vague nature of the functions, none mention anything about martial law or seizing private property. The five functions are also identical to those identified in Clinton?s EO 12919.</p>&#13;
<p>So why did Obama issue the order at all?</p>&#13;
<p><a rel="nofollow" href="https://thenest.vanillacommunities.com/home/leaving?allowTrusted=1&amp;target=http%3A%2F%2Fhotair.com%2Farchives%2F2012%2F03%2F18%2Fnational-defense-resources-preparedness-executive-order-power-grab-or-update%2F">A side-by-side analysis</a> of Obama?s order compared to Clinton?s, conducted by Ed Morrissey of HotAir.com, reveals Obama?s order is essentially just an update to reflect changes in government agency structure.</p>&#13;
<p>?If one takes a look at EO 12919, the big change is in the cabinet itself,? Morrissey writes. ?In 1994, we didn?t have a Department of Homeland Security, for instance, and some of these functions would naturally fall to DHS. In EO 12919, the FEMA director had those responsibilities, and the biggest change between the two is the removal of several references to FEMA (10 in all). Otherwise, there aren?t a lot of changes between the two EOs, which looks mainly like boilerplate.</p>&#13;
<p>?I?m not ruling out the possibility that this is more than it seems,? adds Jacobson, ?but unless and until someone [demonstrates any expansion of powers in the order], I?ll consider this to be routine.?</p>&#13;

                     <p>The U.S. Supreme Court has ruled unanimously in &#13;
favor of an Idaho couple who were prevented from building their dream &#13;
home after the Environmental Protection Agency barred them from building&#13;
 on their land. The agency claimed the property was protected wetlands &#13;
under the federal Clean Water Act.</p>                     <p>The ruling&#13;
 gives property owners the right to challenge an EPA compliance order &#13;
from the time it is issued, rather than waiting for the agency to begin &#13;
enforcement actions.</p>                     <p>The decision comes in &#13;
the case of Chantell and Mike Sackett, who purchased two-thirds of an &#13;
acre of land near the shore of Priest Lake, Idaho. In 2007, they broke &#13;
ground on a planned three-bedroom house, but three days later, EPA &#13;
officials arrived and asked to see their permit for filling in wetlands.&#13;
 The couple, who had only building permits, said they had no idea that &#13;
they needed a permit from the EPA because there were other houses &#13;
nearby.</p>                     <p>Several months later, the EPA issued &#13;
an administrative compliance order directing the couple to remove the &#13;
fill and restore the wetlands. Failure to comply could lead to fines of &#13;
up to $75,000 per day.</p>                     <p>The couple argued that&#13;
 their property is not wetlands, and thus they did not need to get a &#13;
permit to begin construction. The problem, they said, was that there was&#13;
 no reasonable way to challenge the wetlands designation in court &#13;
because the government had not yet sought enforcement of its order.</p>                     <p>The&#13;
 government argued that allowing lawsuits challenging compliance orders,&#13;
 which it views as a warning, would undermine the agency's ability to &#13;
quickly deal with water pollution under the Clean Water Act. But Justice&#13;
 Antonin Scalia, writing for the court, rejected the government's &#13;
argument, saying that the Clean Water Act was not "uniquely designed" to&#13;
 allow the EPA to strong-arm property owners into compliance.</p>                     <p>The&#13;
 court said that such orders would still be useful to quickly stop &#13;
environmental damage even if they could be challenged in court.</p>                     <div>&#13;

                     <p>"Compliance orders will remain an effective &#13;
means of securing prompt voluntary compliance in those many cases where &#13;
there is no substantial basis to question their validity," Justice &#13;
Scalia said.</p>                     <p>Justice Samuel Alito wrote a &#13;
separate opinion saying that it was "unthinkable" that in a nation that &#13;
"values due process," the Sacketts and other property owners could not &#13;
sue the EPA. He called the Clean Water Act "notoriously unclear" and &#13;
urged Congress or the EPA to "provide a reasonably clear rule regarding &#13;
the reach" of the law.</p>                     <p>Business groups from &#13;
the mining, oil, utilities, manufacturing and real estate industries &#13;
supported the Sacketts in urging the court to make it easier to &#13;
challenge EPA compliance orders. But even environmental groups said they&#13;
 did not view the court's decision as a major obstacle to enforcement.</p>                     <p>Nina&#13;
 Mendelson, a law professor at the University of Michigan Law School, &#13;
warns, however, that such challenges could allow corporations to tie up &#13;
the EPA in litigation.</p>                     <p>"Factory farm lagoons &#13;

subject to the Clean Water Act," Mendelson says. "If the EPA were to &#13;

down in court."</p>                     <p>But Damien Schiff, the lawyer&#13;
 for the Sacketts, says the Clean Water Act makes "many, many tools &#13;
available to the EPA to make sure that where there is a serious &#13;
environmental problem ... it can be stopped expeditiously." He said, for&#13;
 example, that the law has "a separate statutory provision that &#13;
authorizes EPA to go into court immediately to obtain a temporary &#13;
restraining order ... [to stop violations] posing as a threat to human &#13;
health or welfare or to the environment."</p>                     <p>For&#13;
 the Sacketts, the court's decision is Step 1 in what could be a long &#13;
process. The decision did not give them clearance to build their home, &#13;
but they now have the chance to bring their case before a judge and &#13;
argue that their property is not wetlands.</p>                     <p>"We&#13;
 are prepared to go forward," Mike Sackett said after the ruling &#13;
Wednesday. "We didn't come this far now not to be able to build our &#13;
house."</p>&#13;

<p>Tonga?s King George Tupou V, who gave up most of his powers to bring a more democratic government to his Pacific island nation, died March 18 at a Hong Kong hospital. He was 63.</p>&#13;
<p>Tongan Prime Minister Lord Siale?ataonga Tu?ivakano announced the king?s death in a brief radio address. The king, who was a bachelor, had a liver transplant last year and suffered other health problems, according to Tongan media reports. </p>&#13;

<p>He had reigned over the island nation of 106,000 since his father, King Taufa?ahau Tupou IV, died in 2006.</p>&#13;
<p>The king?s father had long resisted ceding any powers of Tonga?s absolute monarchy during his four-decade rule. But after his death, rioters unhappy with the pace of reforms took to the streets and destroyed the center of the capital, Nuku?alofa.</p>&#13;
<p>Against that backdrop, the new king delayed his official coronation until 2008 while he put together the framework for sweeping political reforms. Three days before the coronation ceremony, King Tupou announced he was ceding most of his executive powers to a democratically elected parliament. The king remains head of state, and some parliament seats are reserved for nobility.</p>&#13;
<p>While the parliament is now responsible for much of the day-to-day running of the country, the king retains the right to veto laws, decree martial law and dissolve the parliament.</p>&#13;
<p>Pesi Fonua, publisher of the Tongan news Web site Matangi Tonga, said the king also advocated for technologies such as mobile phones and the Internet, and angered some conservative Tongans with his efforts to make the economy more market-driven and open to foreign competition and investment.</p>&#13;
<p>New Zealand Prime Minister John Key released a statement Monday saying that he hopes the king?s work leading Tonga toward democracy will continue.</p>&#13;
<p>?He believed that the monarchy was an instrument of change and can truly be seen as the architect of evolving democracy in Tonga. This will be his enduring legacy,? Key said.</p>&#13;
<p>King Tupou was known for his throwback fashion choices ? which included wearing, at times, a top hat and even a monocle. </p>&#13;
<p>And despite advocating for reforms, he did allow himself the royal obligation of an elaborate coronation, a five-day-long affair that included roast pig feasts, tribal rites and pomp. Its price tag of $2.5 million put a heavy strain on the impoverished nation.</p>&#13;
<p>The prime minister declared that the royal family and the nation were in mourning. Fonua said he ended his address with a Tongan expression meaning ?The sun has set.?</p></div>]]>

        <description><![CDATA[<p>Happy Wednesday! How's everyone doing?</p><p>I sort of hopped on a rascal this past week. I've just been so ravenous - I've been working out more often and also harder, so I suspect that's the culprit. I just have to get back to basics and stick with tracking my food (and beverage) intake. Also, my recovery from NROLFW has taken a lot longer - I'm still incredibly sore in my quads, hamstrings and calves from Monday morning's workout. I'm on Stage 2 (this is my second time going through the program), and I'm lifting much heavier weights at this stage than during my first go-round, but maybe it's too much if I'm still this sore. I just started making whey protein shakes and drinking them after workouts, but it's too early to tell if they help or not. I'm wondering if a foam roller would help too.</p>]]>
