Unless this "John Doe" has some concrete proof, this is a he said/he said incident, I hate to say.
What difference does it make if he is, or not? I mean, other than this lawsuit.

Afterall, he was outed for frequently attending Turkish bath houses in a variety of countries all over the world. I don't know a single straight guy who hangs out in a Turkish bath, LOL!
Yeah, I think it is pretty widely known that he is gay. Don't get me wrong, I love my gays, but he is a big phony. Not just with his sexuality, according to many reports his life is not what he portrays it to be.
