Work-Related Vent: Finally got LTD paperwork

I just need to get this out before I do something rash. Because, right now, I feel like marching into my boss' office and screaming to the point that it sends me into labor.

The HR guy finally sent me the LTD paperwork (only after I emailed him about it twice today. I've been waiting on it for 2 weeks after finding out my leave wasn't going to be paid). He has to send in a section and I have to send in a section. Great. Easy enough.

However, he puts at the bottom of his email that he taking today through January 13 off! I know my EDD isn't until the 19th, but this is why I wanted to finish this in December. There's always the possibility that I go early (especially now that my body is doing so much prep) and since he's dragging his feet, there's now a possibility that this won't get filed in time.

Unbelievable. I knew they were trying to be d*cks to make me quit because they didn't want to let go the pregnant lady in case I would sue, but they've been sinking to new lows (first, not telling me that leave wasn't covered, then deciding not to pay me for funeral leave because it was DH's GGPA and not Gpa - and didn't tell me until after the funeral, and now this).

I. AM. PISSED. They better be okay with me not coming back until 6 weeks after this is officially approved if this gets filed late - because that's what is going to happen.

  • @amccul20 - HR is actually run by our CFO (since they are having issues, a lot positions have been condensed. For example, I'm in marketing but also the admin assistant and doing AP/AR). He's actually above my boss. There's nothing my boss could really do.

    @brij2006 - No. I will, however, be looking for something closer to home. in the event I didn't find something, I would return. I wouldn't quit without having something else lined up though.

  • Well shoot.

    I would respond to his email when your due date is, and why this is so important to get the paperwork processed in a timely manner.

    I would also BCC your personal e-mail on it, just in case they were to go through while you're gone and remove the e-mail you sent.  This way you have a paper trail that you submitted the proper forms and documents in time to get them done.

  • @brij2006 I have BCC'd myself on every email about this. I was afraid this was going to happen. I've repeated my due date to him in several emails and told him that date isn't a deadline and that I could go into labor any time in January. He's just being a prick.

    They want me to quit so they don't have to pay unemployment. I'm not giving them that satisfaction. DH thinks that they are going to let me go on leave so they don't have pay the LTD either.

  • That's just a crappy situation all the way around.  It doesn't sound like that company is doing very well, and I would make it a goal to search for a new position before leave is over.  That way you won't even have to look them in the face again.

  • why are you filing LTD? shouldn't it be STD?

    and it is not abnormal for employers to not provide paid leave for funerals outside of the immediate family. hell, i worked for an employer that wouldn't provide paid leave if my own grandfather passed away. it was siblings, parents and spouse only. did you look in your policy handbook before taking the time off?

  • Wow. If he is going to be gone then he should fill out the paperwork before he leaves...simple as that. Stuff shouldn't be late because someone is gone.

  • I couldn't file my STD paperwork until after the baby was born anyway because there is a section that had to be completed by my doctor indicating when I could return to work.  Plus, there was a two week exclusionary period.  I was eligible for 8 weeks STD because of the c-section, but I had to wait for 2 weeks before they would pay, so I essentially got paid for 6 weeks (at 60% of my salary).

    As of 12/1, they got a new carrier and did away with STD in our company. Only LTD is available.

    As for the funeral leave, the company policy doesn't specify relation, just that "the decision of pay is at the discretion of a team lead." If it's paid, great. If unpaid, fine, let me know and I'll make arrangements to come in afterwards.

    I emailed them the day he died and again on Saturday with a copy of the obit asking about what the decision was about pay and got no response (while the person responsible for the decision was emailing me consistently about other topics). I would have gone in for a half-day if I knew their decision was unpaid. They didn't email me until Tuesday to say that the decision was unpaid. Is it within their rights? Yes. Is a d*ck move? Absolutely.

  • That is a dick move about the funeral leave.

    I'd call the insurance carrier directly and ask about LTD for maternity leave.  I would be very afraid that it would not be paid since maternity is not a long term disability.

  • @rebaann - See, that makes more sense to me. The carrier that we have now says that my paperwork and the employers paper has to be done before I'm admitted. The doctor fills out the last section while I'm in the hospital. Then, I have to wait 30 days for it to take effect and I get 2 weeks of pay at 60% for delivery, 4 weeks if it's a c section.

  • i'm with reba, i would check with the LTD carrier because 6 weeks is not LTD. if you don't have STD, then you just don't have STD. not everybody has STD. i didn't. leave was simply unpaid.

  • I don't have STD or LTD, but I do have what's called "Employee Injury Benefits". It covers 66 3/4% of my salary while I'm on leave. 

    I also don't get paid unless it's my immediate family or DH's immediate family that passes away. It sucks, big time. 

    That being said, your company shouldn't have waited this long. They're being ridiculous and I would have quit long ago.
