Question - Auto accident

I've never been in an auto accident with an injury so I'm not sure how this all goes.  My mom was in a fender bender and ended up with a slight concussion.  she is still having some minor issues but is getting better.  The lady's insurance offered my mom $500 settlement but my mom ended up having to go to the ER and got a cat scan so I'm sure its way more than that and she told the agent that she wouldn't take the settlement because it's gonna cost more than that and I guess they have to do an investigation now.  My mom was not at fault for the accident and the insurance company is going to pay for all the car repairs.  My parents car insurance agent will pay out 1k to my mom even though it wasn't her fault.  In the meantime what does she do about the medical bills?  They haven't come in yet but probably will within the month.

  • Does she have medical insurance?  After my PIP ran out I had to use my health insurance for everything. I hurt my knee - had ER visit, MRI, xray and 2 months of therapy.  Took about 18 months to get the other person's insurance to give me a settlement.

    My parents have medical insurance, but I don't know if the other lady has medical insurance (she does have auto).

  • All I know is in MD, you use your own coverage for PIP through your auto insurance and once it runs out (I only had $2500) it goes to your medical insurance.  I'm wondering if that's that the $1000 is frim.

    Then if there's a settlement you turn in all your medical expensives, time out of work, etc to the other person's insurance to be taken into account for the settlement amount.

    That's what I'm thinking.  I had to give my claim number to all my doctor's visits, and they submitted to my auto insurance who redirected to my health insurance.  Then at the end, I think I had to sign a release for the other person's auto insurance to get my records from each doctors for the settlement.  It's been 5 years, but I think that's what happens.  But it might be difference state to state.

  • I would keep records of all papers, copies, etc.. And, records of all phone calls (names, times, topics discussed, etc.).

    Most auto policies (even bare bones ones) probably have some personal injury liability coverage included, which is why the lady's insurance company offered the $500 to your mom. It seems like a bait to see if she'd take it and then have it be a done deal.

    Have her contact her insurance carrier and find out how the discussions will be handled. In my experience the auto insurance company agents should talk to one another directly - the lady's carrier should not be contacting your mom, but should go through your mom's carrier.
