I would like to work until my 9th month, Sept... and the baby is due Sept 23.
I would also like to use my 4 weeks paid vacation from Sept 1 - to around apox Oct 1.
Am I allowed to be still on my works payroll even when the baby is born then apply for mat leave my last day of holiday. Or do I need to take it before the baby is born
If I am allowed to do this do I file my last day of working as my last day on pay role (Oct 1) or my last day of physically working (Sept 1)

I'm 95% sure that would be okay. You have to apply for mat leave- I don't see why you couldn't just apply a week or two after your baby was born. You'll have to report your vacation earnings, though (you can't get vacation and mat benefits at the same time), so the day you'll have to report to EI as being on mat leave would be Oct 1.
You certainly don't have to take mat leave before the baby is born- you're allowed to work right up until the end.
I was told by my HR that your mat leave begins when the baby is born. I was planning on taking my 3 week vacation, but half way through, DS was born. My unused vacation got carried over to the following year and I added it on to the end of my mat leave, so in the end, it all evens out.
My work issued a Record of Employment, and the last day of employment was the day before DS was born. Unemployment technically kicks in from day 1 your baby is born, but there is a 2w waiting period for benefits.
For EI purposes, your last day of work would be your last vacation day. It is my understanding that your mat leave begins the day your baby is born if you didn't start it earlier.
And remember, your baby won't necessarily be born on your due date! Mine was ten days late.
This exactly. Your plan will work only your baby is late. You start your mat leave the day your baby is born (or earlier if you want) and then your 2 week wait kicks in (once your ROE has been issued). You can not be off on vacation time after the baby is born. I would talk to your HR about what their internal policies are as well.
