Accident with uninsured driver

Background: DH and I bought a new car in November, and DH gave his old car to one of his brothers, but the car is still under DH's name.

A couple of weeks ago, BIL parked the car on the street near his house in Brooklyn. Some poohead driver crashed into it and from what I heard from DH, the back of the car is in bad shape. They have the driver's info.

Fast forward to today - DH finds out that that driver who hit his car is uninsured, but he does have NYS plates and all that so not having insurance is a big no-no in this state. DH is on his way to the police precinct to find out what happens next. I assume there may be a lawsuit involved, but I can't be sure. I don't know much about NYS car insurance laws because even though I have my license, I don't drive. We realllly don't wanna have to pay for anything out-of-pocket since we're in the middle of selling our apartment and then buying a house, and with the damage involved I assume out-of-pocket costs will be high.

So my question is, has anyone here been involved in an accident involving an uninsured driver? Even if your situation is very different it would be good to know what we should expect. I've been googling but I'm not finding NYS-specific situations and I'm tired and don't feel like translating all the legal jargon anyway LOL.
