Our sale is falling apart as I type this

I have no idea what's happening. Prospective buyer *loves* the condo, *loves* the area, blah blah blah. I got a call from my agent tonight that he wants to back out b/c he got scared off by some explanation from our property manager about how our condo association works. Ok, uh, hello buyer? There is legislation in Sask that dictates how condos must be run...we're the same as everyone else! Worst part? The buyer is a lawyer and, instead of taking the Estoppel info to a real estate attorny for review, he has taken it upon himself to do it...and he's a bloody human rights litigator! I feel like I've been kicked in the gut...I am seriously ready to keep this bloody condo and try and sell the new house.

  • oh no. i'm sorry to hear that! anything you can do to change his mind about condo association?!
  • There's been alot of back and forth phone calls. His agent seems to be of the opinion that the dude is totally over-reacting and was on his way over there to see if he could save it. I am not hopeful. Sounds like the guy's mind was made up.
  • sounds like maybe he was looking for an excuse for some reason. maybe something else happened in his life?

either way I'm sorry you're dealing with it. ugh!

  • Oh no!!!! Frick, the what h*ll??? I hope he comes to his senses and doesn't tank this deal.

  • Is he even legally allowed to back out for that reason?
  •  I agree that it sounds like he's looking for some sort of excuse. Hopefully it works out for you - What a PITA!

Usually when you buy a condo you make the offer conditional on reading the association's by-laws/policies whatever you call them.  To catch things like the max dog size is 25 lbs and you have two labs, or restrictions on what you can add to the exterior - satellite dishes, bar-b-q, paint - or what you're responsible for.  Because if you violate the rules they can force you to sell and move.  Extreme, but I did see it threatened once for excessive noise.

I hope his realtor can talk sense into him.  *fingers crossed*

  • Oh Mel!  I am so sorry - I hope it works out for you,
  • How annoying!  But from the sounds of it, if he's trying to do his own legal work, it probably would've been hell trying to close.  I know it sucks, but I'm sure you'll find the perfect buyer for your condo.
