DH is getting sued

Almost a year ago DH got into a car accident. A woman cut across 2 lanes of opposing traffic to make a left turn, and DH t-boned her. No one was hurt, and the police report says this woman was at fault.

This woman didn't even know if she HAD insurance and was total trash to begin with. I did not have a good feeling about her.

I met DH to follow him home to make sure his car would make it. The woman was still there and I asked her if the three kids with her were okay. She replied, "Well I have back problems." Did I ask about you, you slovenly, money grubbing beyatch? Ugh.

I am just livid. Livid doesn't even cover it. I would love to give this woman a HUGE piece of my mind.

The amount isn't specified, is just says, "for under $50,000". WHAT? Really?

Has anyone dealt with this idiotic kind of person or lawsuit before? Should we get a lawyer? Can we counter sue for this woman's annoying existence? 

I'm beyond aggrevated.

  • I would call your insurance company first.  This should be covered and they will at least be able to give you a bit more information on what to do next.

  • I would get a lawyer.  I would also make sure you have all copies of any paperwork, police or witness statements to give to the lawyer.  Good luck...this lady sounds like the waste of space that hit my neighbor last fall.
  • No advice/no personal experience with this situation, but I wanted to wish you two the best of luck with this - that just sucks to have to deal with, so hopefully it will be resolved quickly and painlessly!
  • I would call your insurance agent/company and maybe check with a lawyer.  My EAP at work has a referral program for legal advice and you can get a free 30 min consultation with an attorney.
  • One of my best friends is going through this right now as well. First of all the accident he was involved in was almost two years ago. 8/2 would be the date that the statue of Limitations is up, hense the reason, he was tol the guy decided to do it now, before it ran out. The accident the police considered no fault, but his insurance, State Farm ( God how i hate them), claims there is no such thing as no fault in PA. The guy is suing my firend for $50,000. suppposedly for medical. The only thing he was treated for was a sprained ankle. he had already settled with the insurance for around $900 to fix his truck and for medical. His lawyers friends, one being an assitant DA, said that unless the guy contacts my firend again, don't worry about it. I feel that once they agree to settle with the insurance, it should be a moot point. Supposedly in my firends case, the guy suing him is in major debt and his lawyer is one of those mere,y pulled form the yellow pages, aka abulance chaser.

    Good luck. Hopefully everything works outs and the woman in your case cauing the issue is the way stuck paying.

    I got a look at the papers and they were filed 7/9/09. The accident was 7/19/07. What a coincidence it's right before the 2 year limit is up.

    The police report says she was wrong. Her insurance company said she was wrong and paid us because it was her fault. She's some low life looking for a settlement.

    It really chaps my biscuits that you work hard, do the right thing, try to be a decent human being, and you have jerks like this running around.

    DH called the insurance company and the litigation guy will be calling him tomorrow. They don't even have DH's name right on the court papers. Really? That's some "grade A" law team she's got workin' there.

  • It sucks that you are dealing with this! I went through the same thing a few years ago.  However, the police found neither of us at fault and the guy sued me.  State Farm provided me with an attorney.  The guy tried suing me for 50,000 and ended up getting like 4,000 to cover his med costs and vehicle damages.  Insurance covered everything, however, it was nerve wracking!!!!! I think that your DH will be fine, especially since the police report found her at fault.

  • It REALLY stinks that you guys have to deal with this!! 

    I had an accident like this when I was in high school- I got rear-ended into the car in front of me, and they tried to say it was my fault.  I was worried about having to get a lawyer and stuff, but the insurance co provided the lawyer and took care of everything, since the original police report said that I was not at fault. 

    So, everything was covered and ended up turning out just fine, just like I"m sure it will for you, but it is still a huge pain and very nerve racking to have to go through this kind of ordeal! Best of luck.

     

  • Ugh. Crappy. Hopefully the fact that someone was dumb enough to even take her case is an indication of the quality of their legal skills.  Good luck. I hope it gets resolved quickly and painlessly!

  • No experience, but just wanted to wish you luck. This kind of stuff makes me so angry - if a police report states that she was at fault I don't think ANY kind of lawsuit should even be considered or allowed to be filed! Ridiculous.
  • No real advice, just wanted to wish you lots of luck in dealing with the scum of the Earth there.  I'll keep you in my T&P's! :)
