Someone reassure me...

I just called work and told them I wasn't coming in today. I didn't go yesterday either.

Yesterday I was SO sick. I literally threw up about 10 times into the night. I couldn't get up off the couch and finally called my mom in tears to see if she could come over because I needed to get some food in me.

I have called out or left work a few times early due to the crappy time I'm having. It had gotten a lot better until last night.

I know that I can use FMLA protection when I have to call out due to pregnancy but I am having trouble getting in to see HR to have her help me with the paperwork. I am so so so afraid I am going to lose my job because I've been out so much.

I'm not going back anyway after I have the baby but I really don't want to quit right now. I also don't want to be fired for poor attendance.  I honestly don't think they believe I'm as sick as I am.

They won't just up and fire me, right? They'll talk to me about my attendance before they do that...right?

Someone please reassure me because after yesterday I am a total mess...

ETA: My baby and my own health come first so if it comes down to it, I will just quit...but on the days I feel fine (which can be weeks at a time) there is no need for me to not be at work.

  • First off, I am really sorry you are having such a difficult time with "morning" sickness. : /

    I would say to not use your FMLA until after the baby is born, but since you are not returning, it doesn't matter.

    Your doctor can put you on disability for a pregnancy-related complication, and your job will be protected under FMLA for 12 weeks.

    This can be very complicated and tricky, I know. My mom is an HR expert, so she can answer most, if not all, questions.

     I hope your HR contact can meet with you soon! What did your doc say about putting you out on leave?

  • I don't think they can...but I'm not an HR person, so I don't know for sure. 

    I'm so sorry you're having a rough time!  I would sit in my cube at work and hold the garbage can...just hoping I'd throw up and get rid of the horrible nausea!  

    Are you close to your boss?  Can you talk to him/her about what's going on?  Maybe get a note from your doctor explaining the situation?  Can you work from home at all?  

    I don't know exactly how SDI and FMLA work but I think you have to be working to take advantage of it...so if you quit now (which if you have to do of course you can do it) I don't know if you can still collect.  If you leave early because of the pregnancy, I'm pretty sure you can start collecting SDI...

  • I have kept my boss very in the loop. I was practically crying yesterday when I assured her that if I could come to work- I would.

    If I was going back to work, I wouldn't want to use my FMLA, but I thought by using it I would protect myself from being fired.  I know they can't fire me for being pregnant, but I am sure they can for my attendance...even if it's pregnancy related.

    I did talk to my doctor about going out of work and she said we'd discuss it at my next appt. which is August 10th. I am afraid to outright ask her to write me out of work.  

    This sucks.

  • FMLA protects your job under serious health conditions, extreme morning sickness being one of them.

    You need to tell your doc your situation and explain to her that you are afraid of losing your job, physically unable to work, etc. She should be able to write you off work then.

    I just got off the phone with my boss and I feel better. She said that they all understand and are willing to work with me to get me through this and keep me and baby healthy.

    The doctor called in a prescription for me and if I'm still not keeping food down tomorrow I need to go in for IV fluids.

    I hope the medications work and you don't need to be pumped with fluids. Hopefully the 2nd tri treats you much better  : )

  • So so sorry you are so sick....I know the feeling, the ONLY way i survied was the meds the doc gave me (zofran)...Anyway, what the girls are saying seems right, but I also think that ya your work would talk to you first before ot right firing you.  Most places at least give you a fore warning......
  • I don't know how it is for your company, but I work in HR here and I know that we can't fire anyone without giving them at least some chance to fight it. But I know private industry can be different.

    I suggest you go to your doc now and get documentation stating how bad your MS is, take that directly to HR, appointment or not, and do whatever you need to do with them to make sure they are aware that your doc has stated this. your boss/CWs can believe whatever they want, but a doctors note goes a looooong way with HR. Be more forceful with meeting with your HR. They are there for you and you need to know what your rights are within your company. You have to be your own advacate for this. I see all the time employee get screwed over because they thought their supervisor would take care of it and their supervisor forgot or got it wrong or just plain didn't pay attention. I'm always telling employees to come to us themselves. Again I know that we work differently than a private company, but HR is there to help you and be your buffer with management. Walk into their office and refuse to leave until someone sees you if you have to. Explain your case and provide any and all medical documentation and make sure they CLEARLY lay out exactly what your rights are and what your supervisors rights are, and what options you have available to you. You may want to try and get on disability for a few weeks until your MS starts to clear up. But make sure you talk to HR, they may have other stuff that you can do, like part time or something that you don't know about and your supervisor isn't telling you about. It's not uncommon for us to move a pregnant women into another less stressfull position during her pregnancy too.

  • OH.... I feel your pain!

    I was fired right before I found out I was pregnant, so I didn't have to worry about the M/S and work, so I can't be of any help.

    I hope that it ends for you!!! My M/S went away around 16 weeks, and was even better at 20.

  • Reb, I am sorry that you are not feeling so well. I am glad that your boss is so understanding. You are right that your first priority is you and the baby and I hope the MS goes away soon. Take care!!
