Teachers: Contract question

I currently work in a school district and renewed my contract in April. I was told by another teacher that I have 45 days before the start of school to get out of my contract. That day has come and gone. I just got a voicemail from another school district wanting to do an interview on Monday or Tuesday with me. What would happen if I did the interview and got the job? Would I technically be breaking my contract since school hasn't started? I really don't want to ask HR... I don't want them thinking I'm leaving...

  • I think you'll have to request to be released from your contract since you're past the 45 days. But I wouldn't do that until you have a signed contract from the new school.

  • blah I don't know if that's even worth it (assuming i got the new job). what if they deny me? then my school year will probably suck..

    last time arlington called me for an interview, I was going on maternity leave... can't they call when I can actually take a job? sheesh

  • Like PP said I think you request to opt out of the contract. It was my understanding that school districts honor this request because no one really wants to keep someone who truly doesn't want to be there. I don't see why they would keep you against your wishes ... they could hire a new teacher for less. Hope it all works out. I had lots of friends switch districts for various reasons ... And I wouldn't be surprised if some of my co-workers are no longer at my campus when I return for inservice.

  • It is possible for you to get out of your contract per your request.  However, districts can legally require you to fulfill your contract until they find a suitable replacement for the position which you would leave.

  • Your principal does not have to let you out of it.  A couple of times my MS principal wouldn't release a coach's contract because he waited so long and she wouldn't have been able to find a replacement.  Just be careful. 
  • We had a similar situation at my campus-- we offered a job to someone who already had a contract in another district.  She had to go to their HR office & request that she be released from her contract.  Her district agreed to do so under the condition that they could find a suitable replacement for her position.  It's a risky thing to do b/c the other district most likely will not let you sign their contract until you are released from the other.
