So frustrating...it was not my fault.
I was running an errand from work, and I was driving on a major road in White Plains. I put my blinker on to get out of my exit-only lane, and this guy in an orange car waves me on, telling me to go. So, I go....and he speeds up and smashes into me.
He told me and the cop that he thought I was taking too long so I must have changed my mind.
Literally, between the time he waved me to go, and the time he hit me, was about 2 seconds. How fast am I supposed to merge!?!?!
His car was messed up. He had to get towed away. Thankfully, only the back panel and a little of the door on my driver's side were damaged. But it is sooo frustrating - this is an 11 year old car, but it is in good driving condition. I am not ready to get rid of it just yet (probably within the next year or so), but it kills me to have to get body work done on such an old car. But the damage is *just* bad enough that it's embarrasing to drive the car around like that. Especially parking in the faculty parking lot at work where everyone has nice shiny new cars....![]()
The most frustrating thing is that the cop said it will go down as being MY fault, just because I was merging and he was going straight. The accident report WILL show that he waived me on (he admitted this to both me and the cop) and then that he thought I changed my mind, so my insurance company can fight with his to get them to pay for it, but if they don't win I'll have to deal with my $500 deductible.
I think at that point I will seriously need to consider getting a new car - I don't think my car is even worth $500!

i would recommend taking some photos of the damage, especially in b&w. my mom & i were in a car accident in syracuse that my mom would have been considered at fault for because we had a stop (and we did stop, then were hit by someone flying through an intersection with poor visibility). because we took photos, she was not faulted as the damage made it clear the other driver had been going way too fast.
i agree on maybe considering a new car instead of sinking money into one you weren't planning to keep much longer.

I am curious to see how the police report is going to word this - the cop kept saying "so, basically it was just a misunderstanding" and I kept telling him "no! I understood him perfectly! He said 'go ahead' and then he changed his mind!!"

Oh man, that sucks. I have been in one accident. It was totally not my fault (woman ran a red light; I was turning left at the intersection as she was going straight). It was so frustrating with the ins co because they kept prompting me to say that I hit the other woman's car. I couldn't say exactly whose car hit the other. The adjuster kept pointing out that it would be impossible for the woman to have hit me which was not true. It was a huge argument via phone that was completely pointless since I was not at fault but she insisted the whole time. In the end, it was paid for by the other driver's ins, but I was irritated nonetheless at the process.
Hope it gets resolved soon. If you have to buy a car, I would recommend getting something slightly used.
