question about renting/tenants rights

I live in a two bedroom apartment in Colerain and I pay $600.00 a month.  Last month I found out there was a roach infestation in the building, caused by a family  of 5 living in a 2 bedroom apartment.  I am disgusted by it.  They are treating the place but the problem is still persisting.  Last week, I found maggots on my kitchen floor.  The landlord's son told me that the problem was coming from the unit above me.  GROSS!  That put me over the edge and now the landlord is asking where my rent is.  How do you suggest I negotiate not paying this month's rent?

  • I don't know the specifics of opening an escrow account with the court - but you can't just not pay your rent. If you have a grievance regarding conditions in the apt, then you would need to give the landlord written notice of the conditions and reasonable time to fix them (30 days I think), otherwise you have the right to go file your rent with the Court and the landlord only gets the rent if the conditions are corrected.  If your work has an EAP, it might be worth a 30-min conversation with an attorney.     You need to pay your rent, and make sure you follow your end of the contract (lease) to a T. Make sure all the fault is on them.

    Like she said, you can't just not pay your rent. That would be cause for them to take action against you.
  • Ditto everyone else. 

    I would get something in writing from your landlord stating the date and what he is doing to fix the problem. I would also take pictures of your apartment. You never know if you are going to have to go to court and you need documentation. 

    From a landlord. A lot of work that we do residents don't see. He could be working really hard to take care of this problem, but what he is doing is not working. Also, landlord-tenant law leans to the resident. So, it is probably harder to evict your neighbor than you think. 

  • Have you tried asking your landlord if you can pay for some treatments in your own personal apartment and then have them reimbursed? That woudl atleast help in the short-term. My landlord was very amenable to that when we had pipes leaking.  We bought the parts, submitted our receipts with our rent and deducted that amount from our monthly rent.  As long as we submit paperwork, it saves him time and money to not have to pay the maintenance person to fix things we can fix.

    Obviously, this isn't quite the same, but don't sit around with maggots in the meantime!

  • I'd send your check with a letter documenting the time & date of your calls and that you expect treatment from an exterminator w/in a month.  This sounds like a problem that is above and beyond what the landlord or you can do.  The problem might take longer than a month to resolve (roaches take forever) but they should at least start some kind of treatment.  My only other idea is to call the board of health and see if they will do anything.  The maggot problem has me perplexed.  DH (he's an exterminator) said that those shouldn't be coming from another apartment unless they've got a dead body up there.  He said that it could be ant larvae dropping from above or you might have something dead or rotten in the apartment that you can't see (maybe a mouse?)

    And ditto on the escrow account.

    I was wondering about this. I can't imagine having maggots on the kitchen floor from upstairs.
