How about a poll to get this board rolling?

I would like to start this off by saying this is not a pro or con for gay marriage. It's a state's right vs federal rights question.

The Alliance Defense Fund has filed suit in DC superior court against the DC Board of Elections for their refusal to allow an initiative to ban same-sex marriage. Since DC is not a state this suit could affect us all on a federal level. Even if this case doesn't that is probably the next step.

So my question is, should gay marriage be a federal or a state case? Keep in mind the precendent that has previously been set by cases such as Loving v The commenwealth of Virginia that allowed people of different races to marry.
AGAIN this is not a should gay marriage be legal or not question.

  • I'd have to say no to federal then.  I support gay marriage and think it should be okay across the board, and at least now there are some states where it is legal.  But if they were to vote "no" then there would be nowhere.  Hard thing.

  • I think, since it is more of a Constitutional issue, than it is a federal issue. I am sure it will eventually be taken to the Supreme Court, just like every other big issue, and will be made into a Constitutional Amendment.

  • I'm withholding an answer because I hate Constitutional Law and I think it should DIAF. It would take way too long to spell out the current law on the states rights v. federal rights issues. And I just don't have it in me :) Sorry.
