Freaking out....need words of wisdom.

Ok, so DH and I put an offer in on a house 10 months ago (short sale), 2 weeks ago I received a counter on that offer.  It was only 5k above what I qualify for but we agreed with the rest of the terms.  So, we put in an addendum and are now waiting on a response.  My realtor thought we would have a very quick response but it has been over a week now and I have run into some issues.  5 months ago my lease was up.  My landlord agreed to let me go month to month on my house if I paid 100.00 more a month.  I told her I would get back to her.  I pay 1099.00 a month in rent.  Well did some research and they had 3 rental identical to mine that they were renting at 850.00 a month.  I called her back and talked to her about it.  She agreed not to raise my rent.  So here we are 5 months later and I get a bill in the mail for 500.00 in past due rent.  Aparently she forgot about this conversation and does not recall having it with me.  She says I need to pay the money now and I have to sign a lease.  I had no choice but to put in a 30 day notice (have to be out by Jan. 11th).  I am totally freaking out!  We still do not have an answer on this house and I have to move in just over 3 weeks.  Every month after I sent in my rent I would get a statement/receipt that even showed my rent at 1099.00 and paid in full.  What do I do?!

  • I am guessing you do not have any of the agreements in writing.  If you don't then I would suggest calling your landlord and discussing it with her again.  If she has been understanding about your situation so far, you may just need to remind her about your verbal agreement.  Definitely get whatever you discuss with her in writing going forward.  Good Luck!

     THIS! A verbal agreement will stand up in court (if for some reason she takes you to small claims court) but it will be he said she said. Therefore, if she says she never agreed to that... not sure what they will do. That's why it's imperative to get everything in writing. Good luck!
