F/U to wedding photographer problem...it just gets worse

So for those of you who have not heard my story, I was married in October of 2007 and I still have no wedding photos. 

So a few weeks ago my DH sent them a certified letter and said we want our album by this time or we will be taking legal action. We still haven't heard from them. DH does some searching online last night and finds that they have moved to California and started up a business there. He immediately e-mails them and tells them we were trying to get in touch about our album. He follows up with a PDF of the certified letter.

They e-mail us back and say "our house was foreclosed on, we filed for Chapter 13 bankruptcy, we had to move to California last month, we don't have our computer yet, we thought the albums would cost less than they did and as soon as we can get some clients out here and some business we will have your album" 

Our album is stuck at the manufacturer right now because they don't have the money to pay them for it. WTF?! 

Am I being a cold heartless b*tch? I understand they are having money problems but it wasn't like we were just married. They have been stringing us along all this time with promises of it being just a few more weeks, and "oh a picture got ruined as soon as it's fixed we'll send it", etc".

They referred to their current financial situation as "embarrassing to say the least" and I'm sure it is but why string us along for all this time? Why not just tell us the truth? 

I told DH I wanted to take them to court still (in the end it will be my mom's final decision). He said that it could take years because we would have to work with the bankruptcy court and everything. But who knows how long it will take them to get new clients and find enough money to order our album. And it's not just our album, supposedly they have two other couples who don't have theirs yet either. 

I'm so frustrated and pissed off and I don't know what to do. Who knows when or if we will ever get our pictures. I have no idea how you can get a product from someone who has no money to pay for it. I imagine it's like trying to get blood from a rock. I don't even want to think about getting back the money we paid them for their services. Ugh.

So my question is what do I do and where do I go from here?

  • That would piss me off big time. They should have had the money to begin with, because you paid them. That was a part of the fee. There should be no question as to where they could have gotten the money from. I would lose it.

    Apparently what they did was use our money for something else and then counted on more money from future clients after us to pay for our album. Isn't that the biggest load of BS you've ever heard? Grrr.

    Oh and I don't know if it matters in the situation or if it would help at all but we do have a contract saying they would have us our album within one year of finalizing our design. That will be two years in February.  

  • Is there any way you could get the rights to the pictures?  In lieu of the album?

    That's a pretty good idea, Christen.

    I am assuming they did digital pictures. They should just be able to burn everything on a disc, and send you the disc. Then at least you would have the pictures, and be able to print them how you'd like. You could also create an album using some of the online album makers like shutterfly and just order one from there.

  • try getting a disc of your images.  there are plenty of photographers out there that charge a small fee to do album design for outside clients and can submit to a professional album company for printing.

  • That's a great idea. At least you'll have the photos. Any attorney friends or family that can deliver the request for digital images with a little more zing? You need someone who can get them on the line and cut through their BS all at once. All while offering some carefully worded threats. You've played nice ling enough IMO.
