FML! Re:house update

Well, the mortgage company of my rental property sent me a letter yesterday saying I have until Feb 14th to sell my house or they are starting foreclosure on it.  Turns out they have already turned it over to collections(mind you this is a house I have never missed a payment on in 4 yrs)

They gave me 4 options, that when I try to work with them I don't qualifiy.  Go figure!  I even tried to do a deed in lieu of foreclosure so my credit would only be hurt 3 yrs instead of 7 yrs.  But b/c I've never been late I don't qualify!  Another cathc 22.   I'm so mad and upset that I left the bank crying. 

My realtor is now on the way and we are listing my house 12k below what I owe.  He has less than 30 days to sell a house that was on the market for 2 yrs without an offer.  And even way I have to break the contract with my tenant- she will either have to move when they foreclose or if it sells.

I'm basically hoping for a miracle at this point (or to win the lottery!) Crying

  • This is stupid as hell.  Can you delay it with a civil lawsuit somehow?

    Also, make sure you keep all of the paperwork so that in the future you can show your other creditors what happened with this situation.  Bridget, if I could, I'd buy it from you right now and just rent it out myself.

  • I can't believe it's even legal for them to do this. Not only that, but I don't see what they are gaining from it. I mean it's not like you're not making payments, they are getting paid regardless of what the house is worth. It just doesn't make sense at all. I was thinking the same thing as Mary, if I could buy it I would. Your credit shouldn't get hurt b/c the bank is being being a total douche.

  • Sadly they can!  I read my mortgage docs and it said I must live there for 12 months.  I lived there for over 3 yrs.  The thing is there is some addendum that I missed and I must resided there.  It's complete bullsh!t!!!!

    sending vibes that someone cames along.  i know this is crazy, but have you gone to a tv station about your story?  maybe if you can get on the news, it can help things?

    Great idea!  My realtor actually told me the same thing.  I'm now taking it to all tv stations and politicans in the area.  They are doing so much to avoid foreclosures that a story like this may bring light to this crazy situation.

  • I have two questions. I'm sure both are stupid and you have already thought of if it were possible. I assume this is because of the type of loan you have, why can't you refinance? Or could you sell to your husband? This sucks so bad. I hope you can figure something out.

  • I don't know the backstory on this either but I just wanted to say I'm so sorry that this is happening to you, it just isn't fair or right.  I hope that everything works out.  I think talking to the media is a great idea though.  Good luck!

    Not stupid at all. I can't refi b/c I owe 92K and the house is now worth approx 50K. I can't sell to my hubby b/c he owns the hosue we live in. Plus it won't appraise at what I owe, so I would still have to bring approx 40K to the closing. I've already had numerous ppl including 3 lawyers say give the house back and let the bank take the loss, I really just don't want to hurt my credit.

  • UGH! This is awful.  I can't believe a bank would do this to you.  YOU are doing everything you are suppose to do and they find a little loop hole.  Seriously?!  I'm so sorry you have to deal with this.

  • If you find a buyer, can you do a short sale?  I feel for you -- we had 2 empty houses for almost 2 years.... it's frightening - especially in this economy!
