Advice needed - tell me what you think...

Ok so we just added a deck onto our house and was put on by a reputable contractor.  So Monday was our inspection. We failed.  It failed because the vinyl railing is apparently to high and requires an additional railing on the inside.  Contractor calls us Monday and tells us the news and says no biggie he will add the railing and it will look nice.  Apologized and said our county is the only one in the state that requires it.  So yesterday, DH gets home and the railing is on.  It looks like sh!t.  It isn't properly pieced together and missing screws.  So DH calls contractor, he saysthat this is railing is hard to work with and no way for it to look nice unless you ordered a custom piece.  Well Duh!  Had we known it needed a flipping additional railing we would have done that.  Also says, BTW it's going to be an additional $150. 

 He has already been paid and cashed the checks. 

I'm furious because I feel like first of all you should have known what was code at the time the contract was written up and second we paid you in full for the job based on our estimate/contract and we shouldn't have to pay $150 more for some crappy job.  Before this issue with the railing we were 100% happy, the deck looks awesome minus this railing.

Sorry for the vent, but my question is what would you do?  Just suck it up and pay the $150 for this crappy job?  Pay the $150 and demand it be fixed?  Order the custom piece?  Refuse to pay because it's not in our contract?  Ugh, I just don't know what to do.

  • Ugh...  I wouldn't have paid the total balance until it passed inspection...but since they cashed the checks you can't really do that now.

    I would tell them that they are in breech of contract because they did not build a deck that passes inspection.  I would NOT pay the $150 until the additional railing is completed to your satisfaction.

    You can also file a complaint with the city as well as the Better Business Bureau.  If enough citizens complain about a contractor, it wil lbe harder for them to get permits.

    Depending on the cost of the railing portion of the project it may also be worth it to talk to a lawyer - although you may end up spending more time and money on that then the value of a new railing.

    OR

    Order the custom peice. Have it put in....

    I do think its odd he didnt say/know anything about county codes.

  • I would not pay, and threaten to call the Better business Beaurea. You did not pay in the first place for a deck that wouldnt pass inspection.

  • I'd be pissed!  Call the city and see what you can do about this!

    My dad was an electrical contractor and he said this was your contractors responsibility to plan appropriately from the beginning.

  • Thanks.  I guess we will file a complaint. It sucks because up until this point we were really pleased.  We've had so many compliments from neighbors before the railing fiasco.

    We didn't forsee any problems with it not passing inspection so we paid our final payment on the day it was completed (per our contract).  It's not even about the money, I'm just peeved that he didn't KNOW to do that in the first place and charge us for it.  Then the fact that he did a crappy job adds fuel to the fire.

    Is there anything in the contract about his not holding up his end of the deal or is there an add on contract regarding the extension?
