sticky situation - wwyd?

DH sold an ATV to his friend last June 2009.  They agreed on $3,000, paid in monthly installments of $250.  Friend has paid us a total of $1500 and we haven't gotten a check from him since October.

Friend recently got a promotion at work, now he's DHs boss.

Everytime DH mentions the missing payments, Friend blows him off.  What can we do?  The friendship is pretty much over at this point.  There's huge amount of dramatic details around this, I'm just giving the very basic summary.

  • There isn't much you can do. I would just write off the 1500 and expect to never see it again. I'm sure you've learned this lesson but it's never a good idea to do business with a friend/family.

    My thoughts exactly.  It sucks, but short of taking him to small claims court and putting your DH's job in jeopardy I can't think of another option.

    I know!!!  I said that a year ago, but DH was all like, Oh no, he's a great guy.  We won't have any problems....

    I've never liked this guy but for some reason DH could never see what a jerk he really was.  Unfortunately, DH now realizes what I meant.

    I don't think that's a bad idea. I'd do it.

    Do you know if the ATV is in the same condition as when you sold it? Maybe he stopped paying because he wrecked it or it needs work? Some people have that mentality that if it broke, they don't have to pay for it anymore.

    We have so much time, and so little to do! Strike that, reverse it.

    I don't know.  He's on a race team, so they may have made some modifications to it.

  • I wouldn't take it back simply becuase it may have been damaged.

    Was there a contract or email about payments or final price?

    This is probably something that he's just going to have to forget about. It sucks to not only lose a friend but money on top of it.
