First if you're a title person, I apologize, I got the dumb title person though.
So for the past 6 months we keep getting weird people coming by/mail in our mailbox (not even gone through the mail, just placed in our mail box) saying we owe $125 in HOA fees. I remember specifically signing closing documents and our closer saying there is no HOA fee. We picked the house we're in instead of another one because of HOA fees.
So today, another notice (actually through the post office this time) from a group that handles HOA fees saying we now owe $250. I call them, they look up my name and say yes you have an HOA. Um, well it's not in my paperwork...
I call the title company, they look at my contract and say yes there is an HOA in that subdivision, but whoever filled out your paperwork accidentally marked "NO HOA" Um, how do you mess up something like that? On our settlement statement there is a line that says Dues $375 (3 years of unpaid dues by previous homeowners), so I guess that's how I was suppose to magically know they messed up?
I emailed my aunt and uncle to ask them what they think as far as legal advice, but I'm irritated. My aunt owns her own title company and my uncle is a certified real estate lawyer. Hopefully they know some way we can get out of it. I mean yes we can afford it, and it's no big deal, but it's principal. And all the fee goes to is for them to make the sign/enterance area into the neightborhood look nice. It's not gated or anything like that. I mean, if it's an HOA I'd like them to at least get onto the people for have the car parked in their yard.

In the Real Estate Contract it says no, but according to my uncle it doesn't matter. They collected the past due HOA fees from the sellers and correctly prorated it to us, even though it just says "assessed fees" it is the prorated HOA dues. It's more about principle.
I'm sending a mean ethics letter to both the Title Company and Realtor. Laredo is known for companies/relatives getting together for their own good and not giving a crud about anything else. I hate this backwards town.
Ugh, that sucks. Yeah, HOA fees are not something to have sprung on you...especially through a paperwork mistake!
We've been looking at nwe houses and have noticed the sellers like to give you cost estimate sheets that don't mention the HOA fee either...sneaky...
