So I requested vacation from Mar 1-15 with the intention of starting mat leave after that.  I put in my request in January.

Today I had a meeting with HR and they told me that they feel my pregnancy is affecting my job performance (They do customer call backs, and I got a 37% based on 2 of the probably 500 customers I served last month, which is complete BS.)  Anyways, they wanted me to use tomorrow as my last day,  use up my vacation, and then get 7 pd top up days.  I said no to that offer because I am not ready to go on mat leave already.

 They then tabled a second offer which was basically the same, but I would get to work next week, and have next Friday as my last day.  It was all verbal offers, but I am going to get them in writing before I give an answer, but my question is:

Would you take their offer, spend the extra time with DS, and enjoy the time off, but probably go crazy waiting for the baby to come?

or 

Would you tell them to shove it and stick with the original plan, knowing that they obviously don't want me there, but that they can't force me out of my job?

 They tried to position it like it would be financially beneficial to me to do it, but really, I would be losing almost 2 weeks of pay, so that really didn't work for me.  I know they can't fire me at this point because they have made this offer (and that's why I am asking for it in writing) but does it make sense to take it?  I have to pay daycare until the end of the month, so that factors into it as well...if I were home, I would keep DS home as well, but would be wasting the money on daycare.

  • I haven't, I am calling tomorrow.  They came to me today at 5, and I am pretty sure the MOL call centre closes at 5.

  • Hmmm well if you don't accept their offer they could terminate you based on performance correct?
  • Definitely don't let them force you into anything you are not comfortable with. It does sound like they just want to get you out the door. I would get some advice with the labour board. I am pretty sure they'll say your company should honour your original request. Good luck!

    If they don't want to be sued for wrongful termination they would have to have a record showing they discussed specific performance issues with her and a development/improvement plan and warned her that if her performance didn't improve by x date that she may be at risk of being terminated.

    One discussion won't protect them legally or show cause.

  • I called the ministry today, and they said that I can't be forced out of my job.  Also, because they made an offer to pay me out, they now can't fire me.  It is against the ESA and its a human rights issue because I am pregnant.
