I know you are all wondering what happened with my carpet war. LOL.
It's not good. They sent out an "ndependent Carpet Inspectot to look at the carpet. He came to our house, looked at the carpet for 5 minutes took some pictures, used our bathroom for 10 minutes. EWWWW. Then left. The report came back that the carpet was in fine condition. So Empire is washing their hands of the issue since they have this inspectors word against ours. they won't even talk about anything. They just keep saying, "we have the report". "We have the report."
Our only choices are to hire our own carpet inspector (hundreds of dollars) to dispute their findings, live with the carpet we have, or buy new carpet from them at a discount. I am so frustrated by it all.
My educated guess is that while the carpet inspector is " independent" they know who is paying their bills. I am sure they don't find in favor of the little guy very often. But there's no way to prove this. It's so frustrating.
So this ignorant stance that the company is taking has made me further pissed off. Good business is sometimes finding a scapegoat so you can walk away from your responsibilities to your customers. Way to go Empire! You should be very proud of the way you do business.

that's the only thing we can do. This all just went down so I need to do that next. We told them we were filing with the BBB and he said "do what you need to do". F'ers!
Sounds like you need to contact the BBB.
and start an internet campaign. Put that on Facebook and tell all your friends not to do business with them. They might not care if you can save someone the trouble of having to deal with them in the future than you've done good.
Also, I'd send another letter to them and tell them that you've decided that your only option is to take it to the internet, the BBB, and the newspapers. They might actually step up and help you out once you realize that you're getting ready to bash on them.
Him saying 'do what you need to do' makes me wonder if they STILL won't budge even when you do that. But maybe they think you won't do it.

Ugh. I'm so sorry. I will never use Empire Today. I don't like their jingle either.
In all seriousness though, I hope the BBB can help you out. I think I'd rather pay full price for carpet somewhere else than give those a-holes more money.
