Why didn't she just say this from the freaking beginning instead of saying "Oh well I don't know that the egg has fertlized so I can't be held responsible." Why didn't she just say "we use a condom so there is no statistically feasible chance of even having a fertilized egg."???

Yes, pregnancy. Condoms have a 12% fail rate for pregnancy alone, and BCP have a 3% fail rate.
BCPs don't protect against STDs, and I don't know condom fail rates for STDs.
I wasn't suggesting she should use a condom to stop ovulation...:-P
I was suggesting she use a condom so she didn't have to worry about fertilization in the first place.
Frankly, I'm not about to suggest she stop using any form of bc. The longer she stays out of the pool, the better off we will all be!

I think the fail rate includes breakage or slipping off. It's much lower if it stays intact and on.
I am shocked that there are some people who get pregnant while on the pill and using condoms. Those are some fertile people.

The typical use pregnancy rate among condom users varies depending on the population being studied, ranging from 10?18% per year.[95] The perfect use pregnancy rate of condoms is 2% per year
Birth control rates are typically expressed in "typical use" rates and "lowest expected" rates. The wider the gap, the more user error is involved in "typical use".
Random tangent: withdrawl and FAM have huge "typical use" rates, but very low "lowest expected" rates.

As DH put it, for perfect use [of BCP], you'd have to basically be in a lab.

OK, I finally read through that huge thread. I have to say that when she said this about using a condom my first reaction was she was definitely lying.
Now, I will admit that you guys have gotten me thinking. I would never push for making BCP illegal, but I can see the concern that you have. I would only say that there is no way to know that an egg was fertilized or not (in the case of contraception pre-implantation), so I don't see how this could become a valid lawsuit (unless I'm missing something completely).
FWIW, we do not use contraception (unlike GR8r...whatever her name is). Granted, we're 42 and it would be a dumb time of our lives to do so if we ever want to have a child...but we would still not use any contraception if we had married much younger ....because of our faith.
