So civil rights lawyer wannabe turned defense attorney.  A girl after my own heart!

Can I ask, how long have you been an employment lawyer?  Have you always worked on the defense side?

I've been working in the plaintiffs side since before law school, as a paralegal, then during as a clerk.  A year in government after finishing, and now we've moved and I'm trying desperately to get on the defense side.

If/when it happens, I'm really curious how much my views will change while doing it.

  • It only took one race discrimination case, where a black man lied through his teeth and sent a small family business into bankruptcy to convince me to shift over to the dark side.  I was thoroughly disgusted by the entire situation - the harm to the family, which was a group of very good people, the harm to other AAs who had legitimate claims of discrimination, etc..  The man lost the case, thank goodness, but the matter was so protracted that the family business went belly up in order to pay legal fees.

    In any event, I practiced for nearly a decade and worked at a large firm in Philadelphia.  I'm currently a SAHM to my two kids, who are quite young.

    When you get to the defense side, it won't take long for you to see how many bogus cases are out there.  As a woman who wants to see other women do well on their own merits, I have a hard time stomaching the liars.  I had one case where a woman lied about being sexually assaulted twice by an employee of my client.  She could have ruined that man's life if she had won her case.

    I could on and on, but I'm sure you don't want to read a book.  :-)  Let's just say that it was an eye-opening experience and I have no doubt that it caused me to shift my political views just a wee bit.  However, they were going to shift anyway, so I don't blame my job completely.

  • Interesting.  I think I would enjoy doing defense work at a firm that represented a lot of small businesses.  I think I'd feel less like I'm selling my soul if I was saving a mom and pop operation and not Walmart.  Big Smile

    I will definitely keep you posted.  I've had a few bites from places that seem like they'll be interested once I pass the bar, so I may be paging you to pick your brain for interview advice in December.

    And to be perfectly honest, I reached a point where I felt good even about representing the big companies.  Bogus litigation trickles down to you and me in the form of higher prices of goods, and seeing people lie because they didn't want to, or couldn't, do their jobs just infuriates me, particularly when I know the company tried to do the right thing by the employee.

    Actually, that was what amazed me the most.  Nearly all of my clients really did want to do the right thing, and many bent over backwards to help their employees.

    OK, I'm on the path to writing another book, LOL!!  I'll stop for now...
