workmens comp

Can someone explain how this works to me please? I sad to say, I really am clueless.

TJ's knee has really been bothering him the past month.Thanks to all his years wrestling, his body and joints are just shot. He finally went to an orthopedic dr last week. He gave him antiinflammatory meds and told him therapy 3 times a week for 3 weeks. We didnt even get a chance to set that up till today happened. He fell/jumped from a 5ft wall at work and hurt it more. Can't even put weight on it. They took him to a medexpress. Those people filled out all the workmens comp papers and told him he'll need an mri. But basically he's not allowed to return to work at the time. He's not allowed to do anything except sit at a desk. Which, is no where near what he does! They said a representative will be calling him in a few days. So I'm trying to just find out what to expect.... does workmens comp help him find a temp job thru all this? Do you get a percentage of your pay from workmens comp? Do they do anything at all? I just can't sit around for days not knowing anything at all.

anyone know anything to help me feel better? :-/

  • I know with my workmen's comp i was still paid my regular salary and the days i was out didn't count against me or make me use any of my time. Worksmen comp is pretty strict with their order so make sure he sees the worksmens comp doctors so you get paid .
  • I work at an ortho office so maybe I can help a little-- basically if there isn't a job he can do then they won't let him work-- MRI's sometimes take a long time to get approved by WC (workers comp) and I've seen some take up to a year to get approved/denied they will probably suggest the physical therapy first. Workers Comp will pay him but not his rate that he's at now I think it depends on the case but kinda like unemployment it pays you a %-- Workers Comp people I've dealt with are normally pretty good of course they look out for the company too BUT from what I've seen DON"T get a lawyer involved (no offense to any out there!) but it can get messy in how you can contact the WC people and his employer
  • and Keep up with all the appts and mileage driven because WC will pay you for this too! or I've seen the ones do it down here! you can PM me if you want to too
  • Well TJ doesn't get any paid vaca/sick time to have to use anyway. If he misses work.. he doesn't get paid. Its a small business with only a few employees. The main boss is the labor boss... sandblasting, installing monuments etc. Then the guys also work for his son who has a sign company. Yah, there is sign design thats all computer work. But they also do ALL the installing which involves alot of machinery etc. There wouldn't be enough pc work for him.

    And a year for a MRI to get approved?! thats ridiculous. I'm pissed he can't go today, let alone if he has to wait forever. I don't even know how he'll do the physical therapy if he can't even put weight on it though.

    I'm frustrated and nervous. :-(

  • Just be diligent! Sometimes if it is an emergency situation they go ahead and do it and ask questions later! These are just cases I've seen! Hopefully he can get it done ASAP!! and therapy is all dependent if the dr says he needs it or not obviously if he's getting an MRI I doubt they will order therapy without it first--

  • alright. thanks for the info! I hope they set something up asap just so we have some kind of answers. I just hate sitting around not knowing a thing for god knows how long.

    And can you girls believe the balls his boss has? he was all nice to him when he picked him up from the medexpress to bring him back to the shop. TJ said his boss just called him yelling cause the workmens comp ppl called him. he was saying how he didnt know he had to babysit him. and how he shouldnt have been up if his knee was hurt even tho HE was the one that told him to do it.

    I've been telling him forever to get out of this place. his boss is so cruel to them during work hours.

    I don't know much about workmen's comp but I'm sorry that happened to TJ!  Stupid boss for yelling at him about it later.
