hate you workmen's comp :-( wwAO8d?

sorry if this is long...
So incase anyone doesn't remember...
April 21st, TJ hurt his knee at work, fell off a wall. They took him to a med express and started a workmen's comp case. He hasn't been to work since cause he literally couldn't put any weight on it.. no paid sick or vaca time at this job. So we're getting nothing. They sent him to a doctor.. who was a joke. The assistant saw a slight tear and a slight fracture in the knee. The dr came in and didn't say any of that, TJ just hyperextended it and to go to therapy 2 times a week for 4 weeks then come back to him. And when tj asked for something for the pain, he looked at him like he was a druggie and said no.

2 weeks later, we get a letter saying he was declined cause of missing information. I had him call cause i know i put everything in the mail that they wanted. Apparently it was the doctor that didn't send something in. they were going to review it when he sent it. More time goes by... no calls... no check, which is what we were wanting already! So tj calls TWICE last week with NO return calls. Again today, and she finally calls back. Tj's declined. They're saying its a preexisting condition. Now, he did go to the doctor for his knee the week before for some pain. But that doctor found swelling behind his knee cap... thisss is pain all down the sides of his knee. And you'd think if the jackass doctor said he hyperextended it, thats him saying 'he injured it'. But what do i know.

So i'm just frustrated. We've missed a month of pay AND I'm assuming we're getting these medical bills thrown at us now. Where I work, we have to go thru a certain health system to get coverage and nothing he went to was under it... xrays, mri, the dr, therapy.

He's due for his last therapy session and follow up with jackass on thursday. I'm not sure what to do here...
1.I'm tempted to tell him to cancel. Why get billed more? Maybe he should just go to our health system and get it fixed right and get back to work. Suck it up and take the decline and move on w/ our lives (and our medical bills) he's able to put some weight on it now but it still hurts alot. And he does labor, so he could possssibly get back in a few weeks.. with me being scared of him reinjuring it.
or 2. let him go on thurs and attempt to fight/appeal this. But then he could be sitting around for another couple months getting no pay.

what would you do? :-/

  • hmm Im not sure what i would do but i just wanted to say sorry you're dealing with all this! Sounds like the same kind of luck Serg and I have tho! BOO!!!

  • Can he go to an unbiased doctor?  One that isn't being paid by TJ's employer?  And have that doctor submit his dx?

    I wouldn't just cancel the appt.  Later on, it may look like abandonment on the case.

    I would fight it.  And get lawyer if I had to. In the long run, the price of a lawyer may very well be cheaper than all the medical bills Good Luck with this...

    I'm sorry you are dealing with this.  Does TJ's company offer any short term disability?  Good luck and keep us posted.

    I don't think I'm going to be much help...  Did you guys ever get a 2nd opinion from a different doctor?  Is there any way you could do that now?  How much has the therapy helped?
  • That all really, really sucks. If at all possible, I would fight it. Because the way it sounds right now, he has no pay, and fighting it may take another couple months with no pay, but there's a possibility of getting approved. So there isn't much to lose to fight it, right?

    Fingers crossed things work out for you two!

  • I would appeal the whole thing.  Put your case together with all the information.  I wouldn't have him go on Thursday, but have him go through your health care system to get it fixed correctly.
  • Right after that first appt, TJ asked wc for a second opinion. They told him he had to wait 90 days to pick our own doctor. And therapy has helped his knee loosen up alittle again.. he can bend it more etc. But he's still having the pain. Which makes me wonder if we just forget WC and go to our own doctor, what they'll see on that mri. There's gotta be something going on in there. And I feel like any doctor wc picks, is going to down play it... just a hunch since that assistant said she saw something but the dr didn't.

    As for short term disability. I highly doubt it. Its literally two boses and 2 employees (with a few casual employees when needed), thats the whole company.

    I'm just worried if we fight it, no matter what we'll lose since he did go to the doctor the week before. Which, I think is just a coincidence.

    Why dont you get a second opinion from your doctor and include it in your appeal.  This might help your case if the dr finds something.

I don't have a whole lot of experience with it, but know your insurance won't cover it if it is a work injury and if workmen's comp is saying it's not an injury, then they should cover it? I hope things get better.

    I'm going to call and see if there's something.. anything.. they can do in this kind of situation. I work for a hospital. And we're covered 100% if we go to my hospital or any sister hospitals in our system. If we go out of the network, we have to pay... which all of this is out of the network. I just hope they have some kind of policy on this.

  • GET A LAWYER!!!!!!  This was the best advice I was given and I waiting 6 months to get it.  It was like I was moving in slow motion those first 6 months but once I got the lawyer things went much faster.  I also had the control in my court which was nice.  But seriously, most worker's comp lawyers won't charge you anything unless you get a settlement so go talk to one.  If you case gets rejected or if he gets better and ends up going back to work you don't have to pay them a penny. 

    I got very lucky in that there was a witness to my injury and I'd never hurt my shoulder before so I didn't get this run around, but I was given a doctor who worked for the insurance company who would try to blow off my injury and make it less serious.  The lawyer's doctor was working for me, not insurance, so I got better care.

    ETA: It is true that you have to wait 90 days to see your own doctor, but after that your lawyer will be able to refer you to one of their doctors.  In my case I got a GREAT doctor who took really good care of me and did more expensive treatments that the insurance doctor never would have done.

    I kind of think that maybe you should go through your medical insurance if you are 100%. I would think that geting him cared for is the most important thing. I know NOTHING about worker's comp though so this may be very, very bad advice. Good luck Tammy. I am sorry TJ is in pain and it's a pain in both your a$$es.
