Well, DH did email his HR department and they called him and they said that he shouldn't have been told he would be fired...If he was willing to work with them and open/close the store, coverage should have been found to fill in (which he was willing to do and did tell his DM). His DM then called and said he didn't fully understand the situation and if he had he would have let him have off--easy for him to say since he got his way already and I'm sure that he got a call from HR.
Doesn't help me or my office today, but at least if we have another emergency in the future he hopefully will be taken care of...And I just want to say again that this is abnormal for him--He's been there over 10 years and very rarely calls out.
Re: Update to "Is it Legal"
I was just reading your post below and now looked at this and I am glad everything worked out.
And as for the sick time, as far as I am concerned sick time is sick time whether you're the one sick or your child, and I am very glad that I work in an organization that recognizes it and is more then ok with it. I am beginning to wonder where some people work??? My DH has over 6 weeks of accumulated sick time...what's he going to use that for if he can't use if for times DS is sick? (and he has STD and LTD so if there were ever anything serious he could use that)
Look at it this way...
His sick child is not his employer's responsibility. Why should an employer have special rules for someone with kids, regardless of how often there's an issue? Employees without kids wouldn't have to call in under those circumstances.
