No lawyer for closing?

Seems like all the family wants to give us their input on the purchase of this house. 

 Anyways, my Mom says we don't need a lawyer for closing the sellers attorney should do it all?

 True or False?

  • Heather, don't make me answer this question.  LOL.
  • I think in CT you have to have one.  It is in your best interest to have one anyway.  What happens if something goes wrong, you need someone to have your back.  They also do searchs, etc. for the property for the mortgage.  I am sure others will have more information about the process. 
  • The sellers lawyer will not look in your best interest.  Negotiations can still occur right up to the closing and you want someone on your side.   As a veteran of two crazy nightmare closings, a lawyer is a must, not a nice to have.
  • False!!  No You need your own lawyer to look out for your best interest.  We had a ridiculous situation when we closed and I was so glad we had our own attorney.
  • Oh, we also had issues with the title search, and the seller's attorney certainly wouldn't be looking out for us with that whole thing.
  • Get your own attorney.  It's 500.00 well spent.

  • Ditto MonaLS - the $ was worth it for the peace of mind. You're spending hundreds of thousands of dollars on a new home, what's a few hundred more? You need someone to advocate for YOU, not the seller.

    DO NOT buy a house without an atty, your OWN atty, and please please please find a real estate atty.  There are SO many things that can go wrong and end up really hurting you, either now or years from now when/if you go to sell.  It is the best money you will spend as far as closing costs go.  Ask your realtor or mortgage person for recs if you can't get one from family or friends.

    (the same goes for a home inspector...don't use anyone suggested by the seller or their realtor)

  • It's worth the money!!! Make sure you have your own!! Not the sellers!
  • This would be suicide.

    I would never buy a house without a lawyer.  You have no idea how many documents you will be signing.  Your lawyer will look them over first.  And seriously, my eyes were going blind and by the end I had no idea what I was signing. 

    If you use the sellers attorney, you could unwittingly sign something you didn't mean to and give something important away...like your firstborn child.

    When you go to your closing you are going to be really surprised at the amount of paperwork and I think you will be happy that you have your lawyer there.

    On the same note, I would also pay for title insurance.  It is good for the life of your loan (or for however long you live in the house...I can't remember which) and offers protection.

    Use your own attorney, get title insurance.  That is my advice.  Good Luck and have fun!  There is nothing like receiving your keys at the end of the closing!
