MN Labor Laws

Not sure if anyone will be able to answer this but I thought I would give it a shot. H is an hourly employee at a job that he hates but needs to work while he goes to school. Some weeks he is working 40+ hours but not getting paid overtime. Do companies have to pay overtime for anything over 40 hours a week?

  • I believe that if you're an hourly employee and work  more than 40 hours, you must be paid overtime.
  • Yes.  The only exception is if some of those hours are either holiday or vacation pay.  Even at that, most companies will not allow you to use vacation time over 40 hours a week.

  • He paints cars for a living and somehow his work found the loop hole in paying overtime. If you get paid comission then they do not have to pay overtime. Well, he gets $3.00 comission per car (which is horrible) on top of his hourly pay, so this makes him exempt from getting overtime. I am going to have him call the labor department just to make sure I read it right. Ugh, so frustrating.
