I know it differs from state to state but wondering if there is anyway around this? The police recovered our stuff & arrested the people after our house was robbed and it's now "evidence" they are saying it's going to be at least another couple of months until we get it back (mainly wanting the LCD TV now).
Apparently we have to wait until their trial and everything is over and could be up to a year. They said something about taking a picture of it and then letting us have our things back and now they are pushing that off. Is there a way around this, can they really just a take a pic and how can we go about that? We already tried with insurance and they wont cover it since it's "recovered". I'd love to hear any input, thanks ladies

Lisa, I've worked in law enforcement for the past 12 years and 5 of it was as a bailiff in court. Here in N.C. you can petition the court to have your property returned to you. I'm not sure what the laws are where you are from, but if they've already photographed it, dusted it for prints, and cataloged it in the felony case summery then I don't know why they can't return it. Yes, in some cases I could understand them wanting to keep the items for exhibits in the trial, but we aren't talking about murder here. I don't want to be an armchair quarterback because in law enforcement all cases are different, but on average I don't see why they can't work with you.
