I give up

After all the struggles to hold on to this house, almost losing it then saving it, and struggling since DH lost his job to hang on to it ... we got a certified letter yesterday saying we're behind on the house (!) and that they will foreclose on it if we don't have it caught up by Dec 2.

First of all, I knew we were behind, but not by a whole payment, and we were hoping to get it caught up within the next couple of months. And that only just happened last month ... not because we were out partying and having a fabulous time with the money, but because we got a notice from the HOA (evil bastards) that the bank (even worse evil bastards) haven't paid the fees and if we didn't pay them by Nov 2 (notice the irony there?) they would FC on the house and sell it (for less than $2k, actually). So we tightened our belts a little more, decided to juggle a bit for a couple of months, and paid the HOA with the money that was meant for the rest of last month's house note plus the "extra week" of pay I got that was meant for Christmas gifts ... October had five pay periods so we had everything else paid, except the house. Ever since DH lost his job we've had to split the big house payment into two payments, but it's been paid before the 15th of the month every time.

So I know we're not the $3k behind that BoA is claiming, but I just don't have it in me to fight for this house any more. I mean, it's not WORTH that much money, and if they think they can sell it in a neighborhood that's had houses on the market for a year (even FC's) then more power to them. 

I'm just irritated that we spent all this money this year to get it caught up and everything and now ... it looks like it's all for nothing. I tried to call them yesterday but they were closed of course so I'll try again tomorrow. And once I have "the story" from them, I'm filing a complaint with the Texas AG because I'm pretty sure this would be considered predatory. Our ARM was supposed to adjust in September and we never received anything from them, and interest rates are down again, so I figured nothing had changed. But even so, they can't adjust the rate so much that it adds another $1k+ to the house note every month!

I am just absolutely disgusted. And done, I think. I've heard horror stories of BoA pulling crap like this but I never thought they were true ... boy, was I wrong

  • Oh good grief, I despise BofA.  I had a real estate client who was trying to buy her own parents' house from the estate and they were complete dirtbags to her, jerking her around for nearly a year and making her spend a ton of money jumping through hoops... and then refused her mortgage and she had to go to another lender.

    I'm sorry this is happening to you, I just hope you all land on your feet.

  • *sigh* I know you guys worked so hard to get all caught up - I'm so sorry to hear that. I hope everything works out.

    I hate BoA, too. My parents had their mortgage through them and almost lost it because of some screw-ups. They refinanced through someone else, I think. Gah.

  • Ugh - that is very frustrating!!  I hope that you can appeal it...You'd think in such a bad economy that they would want to help the ones that are close to being caught up so they can keep getting payments versus having a house to mess with through a foreclosure...  Hugs!!  You will get through this!!

  • Thanks everyone. I called today and told them I want a full accounting for the last two years, along with the tax statements I never got and the escrow statement I asked for six months ago; they are supposed to be sending it out.

    I tried to look up the taxes for this year but they haven't posted the bills yet ... however, my house decreased in appraisal value by another $13k this year - meaning that since I closed on the house almost four years ago, I've lost about $35k. While I know the appraisal district's value is often lower than market value, I'm fairly well convinced that it's about the same either way. Unfortunately, we're under water by about $40k ... 

    I don't really know if this will give us any bargaining power with the bank but maybe it's worth a shot, depending on what I see when I get all the statements.
