so ticked and don't know what to do...

NER, obviously.

The company that took DD's newborn shots in the hospital has still not processed payment (she's 4 mos. old for crying out loud!)  I've attempted to pay them 4 times - 3 times by CC, and once by check.  There is no problem with the CC, btw.  I called the CC company, and they have no record of any attempts to collect payment from them.  This company is now sending me letters about putting the account into collections.  I don't know what to do.  They won't accept payment over the phone.

I feel very harrassed and pissed off.  WWYD?

Re: so ticked and don't know what to do...

  • I would write a letter detailing all of the interactions you have had with the company, including the photos being taken, your various efforts to make payment (including dates), phone calls you have made and received regarding payment, and the substance of those phone calls.  Include the fact that your credit card company's records evidence zero effort on the part of the photography company to collect payment despite your repeated authorization for payment.

I would explain that you have complied with their accepted methods of payment as they have been explained to you and that it is a failure on the photography company's part that has resulted in their lack of payment from you.  I would write that you are now receiving harassing correspondence threatening to put this matter into collections and that given your multiple attempts to make payment, this behavior is inappropriate, unprofessional, and unacceptable.

I would conclude by writing that the company is in possession of your credit card information and is responsible for billing you, as you are unable to process the bill payment for them, obviously.  If they need additional information, or require that you provide your CC info again, it is encumbent upon them at this point to contact you for such information, and you request that such contact be made in writing.  If they persist in failing to bill you while simultaneously sending threatening letters, explain that you will contact the Better Business Bureau and possibly legal counsel.

BTW, I suggest all of this presuming that you have, in fact, taken the proper steps on all counts to make payment in a manner acceptable to the photography company, as was explained to you when you contracted with them.

Good luck.  Situations like this are frustrating.

  • Ditto what IIOY said. Great advice. Make sure you keep a signed copy of any correspondence you send them.

  • thanks. guys.  I somehow feel calmer with some direction
  • can you just go to the office and pay in person?

  • Yeah, definitely get that line about the BBB in there. Companies don't screw around with that.

If, for some reason, it continues beyond this letter, I would copy the BBB on any other correspondance.
