My brother's crazy drama...

When I was home for Christmas, my brother and mom filled me in on some drama that my brother is dealing with. He's 19 and in his first year of tech school. When he came home for Christmas break, he found out that a 16-year-old girl at his old high school told everyone (including our cousins) that's she's pregnant and he's the father. According to him, they never dated and he never even slept with her. I absolutely 100% believe my brother-- he's a nice guy in every sense of the word.

He's trying to stay as far away from her and her drama as possible, but she keeps trying to contact him so they can "talk."

I told him that it would be easy enough to just take a paternity test and prove that she's lying. My mom is afraid that if he does that, it's like he's saying that he slept with her and he could get arrested for statutory rape and be labeled as a sex offender (since it would be her word against his). What do you think?

  • Well there are a few things going on here and yes your brother should contact someone if hes that worried.

    1) If he takes a paternity test and proves not to be the father there is no proof that he slept with her. Since he denies sleeping with there shouldnt be anything to worry about. So unless she has proof of sex there would be hard to press charges I would think.

    2) When did he supposedly sleep with her. Hes only 19 and shs 16. Was the before he turned 19? Look into your laws in your state. Whats the age of consent? Some places its 16. In some states there has to be a age difference of a certain amount to be considered stat rape.

    3) Why is this girl saying that the baby is his? Is there a chance hes lying or is she? I mean she has to be pretty dumb to not realize that they can tell who the father is rather easily. He best admit the truth now because if he could bethe father he has a lot to deal with

  • In NJ there has to be over a 3 year age difference for statuatory rape, so your brother would be safe.

    If he is sure he is not the dad, he should refuse to contact her, and even consider a restraining order.  She sounds BSC.

    If there is any chance she is telling the truth, he should consult an attorney.

  • Come clean, and get a lawyer. If he truly did not sleep with her, then there should be nothing to worry about. But if he's trying to keep himself out of trouble and lying about it to do so, it will come back to bite him in the azz. Hope everything works out for him!!!

  • I really am not trying to sound snarky here, but in the age of "CSI", "Maury" and "16 and Pregnant", I am having a hard time believing that this girl is lying.

    She HAS to know that DNA will exonerate your brother.....

    Unless you believe that she has an even deeper, ulterior motive.

    I just checked into the laws. In our state 16 is the age of consent.

     

    It's almost incomprehensible that some one would say "you're the father of my baby," if they never slept together. I guess that's the scariest part. Either she's completely off-the-hook BSC, or he's lying. I really do believe him though, because he's a stand-up kid who doesn't shirk his responsibilities.

    The poor girl has had some very traumatic experiences this year too, so maybe that factors into it. She found someone that she wants to cling too... I don't know. I really just needed some outside perspective on it-- we're in a small very connected town, and there's no one to look at the situation objectively.
