Can someone please give me the facts?!

Today a friend asked me if I heard about the new law that would tax my backyard garden. A couple months ago I read about S510 and everyone saying it will outlaw saving seeds and not allowing private gardens. She did not know any more about it, or if it was even that one.

If you have any facts about how these bill(s) will affect organic or home gardens, please let me know. I've tried googling but come up with a bajillion different answers.

  • I think you are talking about the bill (S510) that passed a few weeks ago. I heard a lot of gossip online about it and researched it online and found most of it to be false. The bill is about being able to track where our food comes from so if another outbreak of something happens they are able to know where the product came from and where it is sold. The problem that I saw with the bill is that this included everything that is grown. Now, I guess some people could believe that to mean your neighbor could sue you if you gave him a bad tomato or something but I was more concerned about my farmers market farmers. The government is having the companies that sell the food pay for their share of the system to be able to track all of this food. I felt that it was an undue burden on local and organic farmers who weren't responsible for all of the outbreaks in the first place and I emailed both my senators. I got a response back when the final bill was passed and it has an exemption for farmers that sell their product within a specific area (like 250 miles or something) and home farmers. :)

     

  • This is the FDA Food Safety Modernization Act and it was signed into law this year.  The final version of the bill is H.R. 2751. You can get the text of the bill here.  It's 80-some pages long and I will be honest that I didn't read it all.  I did skim it though, though, and I don't see anywhere where they're taxing private gardens, outlawing saving seeds or forbidding private gardens. Here's the FDA's webpage about the bill. 

    Just thinking logically, would the president - whose wife is all about the White House garden and encouraging others to grow gardens - really sign something taxing and/or forbidding private gardens?  My guess is your friend heard someone else's version of the "facts" that were aimed at creating fear and opposition to the bill.

  • So if I give away garden produce this summer I can't be punished in any way?
