another landlord question.....

So our tenant said he may be leaving end of Jan if not than beginning of Feb sometime. Now if he leaves the beginning of Feb does he have to pay us the rent on Feb 1st?

  • I would think it depends on the terms of the lease.  Does he have a month to month or a yearly lease? Did he put down a security deposit? Are there damages?

  • We have a month to month lease. As for the security depoist he doesn't have one bc when we bought the house the old landlord said he used the secuirty deposit one month bc he was unemployed and had no money to pay the rent to the landlord let him use that. We ended up just having him sign a letter that said he didn't have a secuirty deposit as he had used it with the previous landlord. This is the 1st time we have had to do this so not quite sure if he has to pay or not. I would assume so but just not sure.

     

  • Probably not the full month then.  Maybe prorate it until the time he leaves.  He only has to give you 30 days notice but if the rent is due on the first and he just gave you notice today then he has to be out by Feb 10 and should pay you for those 10 days.

  • I go from 30 days from when they give their notice.  So if they give notice on 1/15, they have to pay half a month's rent in February.  Those are the terms of our TAW agreement.

  • In the terms of our lease even if the original lease is up and they are now month to month the terms of the original lease apply.  Ours need to give 45 days notice.  If they leave prior to then they are responsible for the 45 days unless we are able to rent it sooner...which is usually unlikely since the place always needs to be cleaned up after someone vacates....(new paint, trash left etc).  Our lease is about 8 pages long and pretty extensive.
