Discuss: PA woman's fall in mall fountain

A mall employee was texting while walking and missed that there was a big fountain in front of her. She hit the small retaining wall and fell into the fountain. Two days later, video of her fall is viral on YouTube, which she found out about only by her nephew. Now, she's suing the mall security guards for #1 - leaking the video and causing further embarassment (via millions of people viewing the video and laughing about it) and #2 - not immediately coming to her aide. From what I hear, it's not been confirmed that the security guards are the ones who leaked the video, but it does make sense.

What do you think? Is she right to sue? Is she being ridiculous and hasty because she's now just overly embarassed?

  • I saw this a few nights ago on the O'Reilly Factor. I think it's hilarious and she should have been watching where she was walking. I hope she doesn't win this suit, it's petty, does that mean if others in the mall watched her do this, she would sue them too if they were laughing at her?

  • People are stupid!  I heard yesterday that some guy's suing because he had a heart attack after he was caught shoplifting (due to the adrenaline of getting caught)  Seriously people, take responsibility for yourself!

    (I think it was bad if it was really mall security who leaked the video but maybe it was someone with a cell phone camera or something)

    she certainly has the right to sue b/c the mall shouldn't have released the video on you tube (then again, mall security wth do you expect ?!?) but from what i gather, she fell into the fountain and got herself OUT of the fountation w/ relative ease almost immediately.

    do I think she should sue .. mmm not on your life. you get yourself in a stupid situation like that, you better be prepared for the fallout.

  • Really? Has this woman never laughed at another's misfortune/clumsiness? Has she never chuckled at someone getting hit in the crotch on America's Funniest Home Videos? Or giggled at someone taking an unexpected pie to the face? Has she never even watched a video of someone else being a klutz? Because if she has (which I'm willing to bet she has, because who hasn't?) then she's a hypocrite. And if she hasn't, then she should be nominated for sainthood or something.

    She even said in the video "I admit it was funny, but nobody took my feelings into consideration". Nobody could see her face. And if she had never said anything, nobody would have ever really known it was her. Plus, she complains that nobody came to her aid -- but that's a lie. She mentioned a woman at a store who helped her after she immediately walked out of the fountain on her own. And again, does she always stop to help people in similar situations? Or is this only important now because it's her?

    It was certainly unprofessional and inappropriate for mall employees to leak the video (if that was, in fact, who did it). And those individuals should be held accountable. I guess it depends on what she expects to get out of the lawsuit? Would she be happy if they were just punished? Or is she really just looking for a payout?

     Seriously though, her case will be thrown out. There really aren't any laws being broken here (not even privacy because I'm sure they have signs saying you are video taped). She should really have just ignored it and she would have been old news by now.

  • People are just way too sue-happy.
    Unfortunatly, I've heard of cases win for much worse (a burglar breaking into a home and hurting themselves, suing the homeowners and winning).

    If you can't see a big ass fountain ahead of you, then you have bigger problems that only an eye doctor can help you with.

  • She needs to suck it up and learn that if you're going to text you need to not walk. Good grief I'd hate to see how she is behind the wheel.
