F/U: Obnoxious upstairs neighbor (Long, awkward, and PIP-filled)

So y'all know I have nothing but disdain for the girl who lives above me. I posted like a week ago that the landy lady was supposed to talk to her.

http://community.thenest.com/cs/ks/forums/thread/48560234.aspx

I gave it a week, and it has actually gotten worse. I think we just ended up pissing her off because she's being super noisy and spiteful. It's over the top and obvious. It turns out she's 18 years old and a total DOUCHEBAG. I meant to post this last week but never got around to it. It poured down rain here all day on Wednesday or Thursday (I forget which), and Clinton called me around 5:30 or 6 & asked me to come get him from campus where he'd been working in the lab all day. I walked out to our parking lot with my umbrella & I was freaking BOXED IN. I'm trying to figure out how to explain this. Our parking lot isn't one of these:

It's one of these where there's just one row & you pull up to the curb.

(Yeah, just drew those really quick in "Paint" to illustrate my point b/c I can't describe my parking lot. Sweet life, Sara.)

ANYWAY, I couldn't back out of my spot b/c there was a freaking blue minivan parked perpendicular right behind me with its flashers on & no one inside. So I did the only thing I could think to do. I LEANED on my horn & hoped someone would hear me & come out. I didn't want to go knocking on every door in my building looking for the owner of a minivan. It was raining & my poor husband was waiting for me. I waited a minute & no one came out so I ran back into the building. The lady across the hall poked her head out & said the van belonged to a friend of the girl upstairs. *sonofabitch* So I had to go upstairs & knock. The girl actually brought her smug teenager face to the door this time. I asked her if the van belonged to someone in her apartment, and her exact words were, "Yeah. She'll be down in like 10 minutes." I pretty much felt exactly like this.

image(thank you hyperbole and a half)

But I calmly explained to her that I didn't have ten minutes to wait for her friend. I needed to leave right now. My husband was waiting for me to pick him up. IN. THE. RAIN.

She glared at me for a second & then said, "Fine. Whatever." And shut the door. I stood and waited. She probably saw me standing menacingly through the peephole.

After four minutes, her friend came out & I followed her down the stairs to the parking lot. She moved her van & I left. Twenty five minutes after DH asked me to pick him up, I finally got there. He was PISSED. And wet. In summary, the CHILD upstairs needs to move back in with her mom where she can get a spanking and a time out. It doesn't look like things are going to get any better as long as we're here b/c there's really no dealing with crazy people. Thank God our lease is up in a few months.

  • Oh man. BBC (b!tches be crazy).  What does your lease say about noise?  Because I'm betting hers says whatever yous says.  Don't most apartment leases include clauses about noise?  I would point this out to the land lady; I bet it's grounds for breaking your lease without penalty if she refuses to take care of it.   (Though I have no legal training).
  • I would have smacked that smug look right of her slutty mcslutster face.

That's ridiculous. I guess if she doesn't quiet down you can eventually file another complaint with the landlord. Not sure if it would do anything, but maybe it'll get to the point where they can evict her.

  • Ugh, Sara, she sounds awful.

Our parking lot at our old apt looked a lot like yours and we got boxed in a couple of times, but it was far more common to have somebody's guests park in the spots reserved for residents, which was incredibly annoying and often meant us having to cart groceries in from ridiculously far away. We wrote several car notes.

She sounds like a b-i-t-c-h. I agree with Jena about filing another noise complaint and if that doesn't work, talk to your landlord about breaking your lease early (or on getting her evicted, but I think the lease breaking is probably more likely.)

    Good Luck!

  • At this point, you are nicer than me.  I would have called the police and told the you were trapped because someone was illegally parked behind you.  I would have been more inclined when I found out who it belonged to.  Screw her the b!tch

  • I too would file another noise complaint.  She may not get evicted, but if she tries to get another apartment, she won't get glowing references from this landlord.

I would have said she had two minutes before I called the cops and had her car towed. Next time she gets loud do the same thing. I have no patience for this kind of crap.

    This.

Lord.  It sounds like you need to push your landlord to take more serious action.  I know when we received our "Noise Notice" (unwarranted IMO as I mentioned in your previous post), it said if we received one (or two?) more noise complaints, we would be evicted (after I talked to management, they assured me that the letter was just their standard protocol for any noise complaints).  I would hope that you landlord/management has something like this in place.

You're paying $$$ for a comfortable home, not a dorm.  Hopefully your management realizes they need to hold up their end of the bargain (supplying said comfortable and quiet home) with either threatening eviction of the gal upstairs or letting you out of your lease.

Good Luck, Girl!!  Keep us posted. I'm enraged for you!!

Edit*  I LOVE the maps and the hyperbole reference!!

This.  And I would start calling the cops every single time she's noisy past whatever time your local noise bylaw is.

  • Ugh!  How obnoxious.  Our parking lot is the same.  Fortunately, we haven't had that happen to us yet.

File another written complaint with the landlord, so there is documentation.  And, yes, get police involved when necessary (loud after 10pm, illegal parking, etc.)  Her behavior is NOT acceptable!  Sorry!

Oh, and I love the hyperbole reference! :)

Lord.  It sounds like you need to push your landlord to take more serious action.

I don't know what the laws are where you live, but the laws in MA are very tenant friendly.  It''s practically impossible to evict someone, no matter how terrible a tenant they may be.

With that said, document, document, document.  Every time you go up there and knock on her door, every time you call your landlord about her, and, (should it get that far), every time you file a noise complaint with the police - write it all down with dates, times, etc. If nothing else, it will help your landlord build a case against her, and it should help you break your lease if it becomes totally unbearable.

    Good luck!
