H was just fired.

H just called me to tell me that when he got into work this morning his boss told him he was done. I asked him what he did and his boss told him that he didnt like that H didnt take coffee/smoke breaks with the other guys at the shop (h has worked there since the shop opened and has never taken coffee breaks he is paid straight comission so if he takes a break he doesnt get paid) H is the highest paid body man in our area, and in 10 years had never had a job come back. I went out to the shop to help him pack up his tools and his boss's wife hands me his last pay check and I asked what H did to get fired, and she told me that his wages were getting too high and that Boss wasnt making any money. H makes 50% comission on job time (no parts). and 9 times out of 10 he gets the job done in less time than was figured for the job, so more jobs get through the shop. This was completely out of the blue. H just got a raise in January and a promotion. Since the promotion he has been working 6 days a week, and Boss even commented that they had doubled how many vehicles they were getting through the shop in a week.

The only thing I keep thinking is that another body shop in town just up and closed its doors on monday and the guys there didnt make much money. Boss could hire one of them for less than was he pays h, and the new guy would make more money and boss would make more money, it just really sucks.

  • One thing we were wondering, is in North Dakota he is supose to get paid his vacation time, and he was not. What can we do to get the money? His boss hung up on him when he called. I will try call at lunch, but I am guessing that he isnt going to pay it.

    On the plus side we live in an area where Jobs are abundent, and there isnt enough people to fill the jobs. THe down side, is that they are all oilfield and he wont get paid what he was getting paid and will be working 24hour shifts.

    I'd start by sending a certified letter.

  • Not sure about ND laws, but you can also try to contact the state's division of Wage and Hour at the DOL.

  • I would love for H to open his own shop, the problem is in our area right now buildings (small 1 or 2 stall buildings) are going for 2+ million due to the increas in oil activity, plus the cost of paint booths, and other set up, we would be looking at 2.5 mill to get up and running at the least. H has considered taking a 2 week course to learn a few new techniques that have come out in the past 10 years since he has been out of school, on Paintless dent repair then doing it out of our garage, or going to the dealerships while he is looking for a shop in our area. He has a standing job offer with another body shop, but he would be taking a significant pay cut ($40/hour to $15/hour).
  • my family always takes their cars to a guy who works out of his garage. it's just him working there so he does things a bit cheaper which is nice.
