EIN for Multi-Member LLC

When you apply for an EIN as a multi-member LLC do you classify it as a partnership when filling out the form?

  • Yes, a multi-member LLC is a partnership (Form 1065).

  • I should have clarified - when originally filing for an EIN do you file as a Partnership for a Multi-Member LLC.

    LLC's are kind of complicated without knowing all of the details.

  • I have but it's not clear in the instructions when initially applying for an EIN.  It will not let you complete the online form as a multi-member LLC and you have to change the type.  But then your legal name isn't allowed to have LLC in the title when you apply as a partnership. 

     I have filed online for multiple single member LLCs to obtain EIN numbers and never had a problem - it's the multi-member LLC that is giving me some difficulty. 

     Maybe I'll just suck it up and fill out the form and mail it in vs. trying to do it online.  More of a wait but oh well.  

    (My question is regarding Form SS4 - for the record) 

  • Well from a tax standpoint I know that it can be a C Corporation, an S Corporation or a Partnership depending on the entity classification.

    Do you want to have LLC in your name? If so, just apply as a corporation and then file the entity classification form right afterwards. Do you have a CPA or attorney you can talk to for guidance? The type of entity you choose can be very important so it may a good idea to get some professional advice. Sorry I'm not much help, but this is kind of a big deal and I don't want to give incorrect advice without knowing all of the details...

    The entity type is always a part of the legal name.  So LLC has to be included.  The LLC I own will be taxed as a partnership.  It's just this one Form SS4 to obtain an EIN is tricky when you are trying to file it online.  

     Basically if you actually physically fill out the form and mail it - you would write at the top "My Business LLC" and then type of entity check Partnership (there is no LLC option and if it was a a single member you would check other and write Disregarded Entity).  The online form just goes about it differently.  And when I've tried to do it as an LLC it was giving me some difficulty.  So I think I'll give it one more go and if it still doesn't let me complete it I'll just send in the paper form.
