Stick out tongue   For real though, doesn't sound like they can legally deny you OT if they offer it to everyone else. 

 

Here is the answer from mi madre:

No they can not deny her the overtime unless she has a doctor's note restricting her time or lifiting.  In fact, there is a case from 1991 ( Internat?l Union, United Auto., Aerospace & Agric. Implement Workers of Am. v. Johnson Controls)  that speaks to this very instance.  It says pregnant women can work in hazardous conditions, even work involving substances that could harm a fetus,  so long as the employee is capable of doing the work, there is no BFOQ that would justify basing employment decisions, such as whether to allow the employee to work with hazardous chemicals, on the pregnancy.

  • Thanks.  If I had known my pregnancy would affect my overtime, I would have done things differently from the beginning and covered my bases before it came an issue.  Now I have to do a ton of research on my rights and present that to HR. Grr.

    Thanks.  I am trying to get organized and do as much research as possible.  I am trying to find my employee handbook (or a copy of one).  Not sure what happened to that thing.  Shame on me!
