Our tech team has launched updates to The Nest today. As a result of these updates, members of the Nest Community will need to change their password in order to continue participating in the community. In addition, The Nest community member's avatars will be replaced with generic default avatars. If you wish to revert to your original avatar, you will need to re-upload it via The Nest.

Is PTO considered a benefit?
According to the FMLA policy "FMLA leave may be unpaid, but it is ?job protected.? That means a worker has the right to return to the same job, or one that?s very similar in its pay, benefits, and working conditions, to the original job. But if a worker?s leave exceeds 12 weeks, all bets are off. The employer need not by law reinstate the worker, although, of course, many business do so anyway"
If a company changes the PTO policy for people taking FMLA would this violate the policy?

Sorry to be so vague... Here is what HR is telling me.
FMLA will begin Aug 2011 taking 12 weeks, which would have me returning in November. January 2012 PTO renews for everyone but since I had FMLA in the past 12 months I will not be eligible to take PTO until August 2012.
Our PTO is use it or lose it so I would have to take all my time between Aug - Dec. And no PTO or unpaid time from November 2011 - August 2012.
If I only take 8 weeks I will be eligible for PTO in January along with everyone else.
