Lawyers: (or anyone) What happens next??

I think I told you guys that back in Feb I walked out of my office to see some douche taking stuff out of Chris' toolbox on his truck? Did I tell you that? http://www.lifeisbeachykeen.com/?p=1963 (there, I wrote about it)..

Anyways. It happened on Feb 24th.. I called the Police and filed a report.. So today I get a thing in the mail saying that they caught the guy (his name is Arthur Hicks if you want to check out the Hernando County jail site http://www.hernandosheriff.org/Jail/Applications/JailSearch/JailSearchDetails.aspx?BookNo=HCSO11JBN001622)  Lol is that wrong?

They sent me this paper work that I'm supposed to fill out "victim impact statement".. the guy wasn't able to take anything. I guess I fill out this paper work with all "no's"

What will really even happen to this guy? I mean, he didn't actually take anything. The toolbox wasn't locked (the lock is broken). He didn't get inside the cab of the truck.. He didn't hurt me.

I actually kind of wonder why I even called the police..then i think, well duh, the guy was standing in the back of the truck, what else does a normal person do?

Did I do the right thing? I'm such a sap. I actually feel a little bit bad. I'm an idiot. Please some sent me some ball dust so I can grow some ballz.

  • Do NOT feel bad about calling the cops on this DB. He obviously had no respect for you or your belongings. He tried to steal your stuff!!! He's a bad person who decided to leech off of contributing members of society because he is a lazy piece of crap. And while he didn't get anything from you (thankfully), he was probably able to steal from someone else.

  • Thanks for the tip.  I'll have H's secretary (cough, cough) send him a flyer for H's services. He will need representation.  Cool

Burglary ain't not joke.  He had  $3,000 bond.  That ain't no joke either.

What will happen?  I'll ask H what he thinks.

    lol.

I thought 3k was a lot too. I was surprised it was so much. I can't believe they caught him a few weeks later.

  • Whoa, that's a crazy story to come out and find someone digging around in the bed of your truck.  I would have done the same thing!  And I agree $3K is a lot.

how did they catch him? I bet he was doing the same somewhere else, maybe that is why the 3k bond, maybe he has a past record, maybe on a probation or something. Maybe he'll learn to not snoop around for a easy steal.

The charge says burglary of a conveyance (1ct)  ...So Im' assuming the only charge is being in the back of my truck... I don't know how they caught him. I didn't even know he had been caught until I got the paper work from the court yesterday. I'm assuming it had to do w/ the car that he left the scene in. We got a picture or it..they put a BOLO (??) out on it.. maybe he got pulled over? No clue.

I looked up the statute.. it says it's a Level 4, 3rd degree felony.. huh.

    810.02(4)(b)

    3rd

Burglary, or attempted burglary, of an unoccupied conveyance; unarmed; no assault or battery.

  • Dave said it is a 3rd degree felony.  What happens next, he goes for an arraignment.  No clue what that means.

He asked, well can Jena ID him?  I said, she's already looked him up online and saw his pic.  He says well, I've lost casing when victims do that.

After I was still trying to figure out arraignment, I lost him.

  • Tell Dave sorry.

I looked him up because I didn't know what case it was for.. Y'know bc our cars got stuff stolen out of them in Nov..and then there was this case. I didn't know which it was. oops.

If they wanted me to ID him, why wouldn't they have contacted me when he was still in jail? That would make more sense...in my head anyways.

No, I would have looked him up online too, if I was in your shoes.  It just makes it hard for the prosecution to prove you remember it is him when you just saw a picture online.  I bet it won't even get to the point where you'll be called in though.  He'll take a plea or something.

I hope I don't have to go to court over this mess. I definitely wouldn't have thought it's a 3rd deg. felony. wowser

  • That's crazy stuff!  do you remember when I cryptically mentioned that some DB walked out on his check and when the other bartender approached him he drew a stolen butterknife on him?  That was before Christmas and he's still in!  His bond is 15,500 for armed robbery and resisting arrest.  What a dumbas$  His tab was $30...  I don't like to talk about it online bc honestly I'm afraid of him.  He's been locked up a long time and I'm afraid when he gets out he will make another appearance.  I picture him sitting in his cell writing our name on his cement wall over and over and making a plan for revenge.Confused  Maybe I need some ball dust also!

    Wow!

I'm a little worried that this guy will show back up @ the hospital looking for Chris' truck! I mean, a 3rd deg. felony ain't no joke, and it's over something so stupid.. I understand your fear.
