Need Advice if you have ever been in auto accident..

So earlier this week I was involved in an auto accident where the other party is at fault. My car flipped on its side so it is totaled.  I do not feel the amount that they are offering me for my vehicle is fair.  What is my recourse? I let them know I was not happy about the amount.  When I look at suggested retail its around $15000-$16000 from Kellybluebook or NADA and that doesn't even include some extra options that we have installed.  I'm not looking for anything unreasonable, but friday they told me my value of vehicle was $13000ish, its a 2007 Chrystler T&C Touring.  I have tow package installed and also alarm/car starter installed.  Vehicle was in great condition as we have always parked it in a garage.  I guess I'm asking is what they offer you for the vehicle the end offer or is there negotiating or what is your experience if you have been in this situation. Not to mention we are out $1000.00 towards our purchase of a lifetime warranty that they say isn't anything they even consider.

  • My DH said you need a lawyer, he's been through it. He said the insurance company is just trying to get out as easy as possible and you need to fight to get your proper value, more than just the car value to consider as well...rental car cost for the interim, any medical expenses if you have them....his advice was to get a lawyer to talk to them for sure.

    I think that if ever you feel like you are being dealt with in an unfair manner, it is time to get a lawyer, even to just get an opinion from a professional who deals with these issues on a regular basis.

  • Personally, I would try talking to the insurance company myself, first, before spending the money on a lawyer.  Present the information that you found - values from KBB, NADA, Edmunds, etc., as well as the details you've given to us regarding the upgrades and features.  You can also call your own insurance agent/company for advice, and they should be more than willing to help.   

    While insurance companies use their own 'formulas' to determine value, they will have to take into consideration the information that you present to them, and if they think you have a valid point, then they'll probably work out a new figure to save further hassle.

    Maybe in the end you'll need to go with a lawyer, but I'd definitely try these routes first.  Sorry you're going through this, and good luck!

  • I agree with Merin, I would try to talk to them first and go to your own ins for help, I would think they would have some tips for you. Also if they do not agree to increase what they are giving you I would be sure to make it very clear to them that you are going to hire a lawyer. Sometimes that alone will help get them to increase their settlement amount.
