Ugh, so I gave our 30 day notice today.... We were under a lease, until July 31 2011 so I thought, until Landlord told us she leased our guest house to a couple that were moving in July 1. When I questioned this a few weeks ago, she pointed out that our lease had a "Typo" and said it was up on July 31,2010. So she said she needed us out June 30, so her new tenants could move in. Fast forward to today when I told gave her written 30 day notice, because by her own admission we are not under a lease, she flipped out and told DH that she was going to take us to court if we didn't pay May's rent. When we moved in we paid 1st and last and security, so May will be our last month, therefore already paid for. She then proceeded to slam the door in DH face.
It really seems she wants everything her way, she can rent out our house before lease is suppose to be up (if there wasn't a typo), yet when we give 30 days notice, because of the typo we are awful people.
AHHHHH this month cannot go fast enough! It sucks that we live on the same property and share a kitchen, laundry and yard.
Re: I despise our landlord (Vent)
I am so sorry to hear that. Landlord/tenant situations are always tough. I dealt with a similiar one a while ago. I never resigned my lease, which was an oversight on her part. Then when he violated my lease, I had no leverage to go against her. It was a mess. I just did what I could to leave.
Maybe you just need to forgo your security deposit just so you can wipe your hands of the situation. That is what I did. The money wasn't worth the stress. Good luck!
Tell her she should take you to the court... tenants win 98% of the time. And her stupid excuse that there was a typo on the lease would not fly at any court. Legally, she should be giving you back your security too, but judging from her bi*chiness she spent it and did not put in a separate account as collateral. Yes, I would tell her to please do take you to court, you may get some money out of it
EDIT: I just remembered - don't you study law? Who does she think she is scaring with her threats? You probably feel like fish in the water in the court.
All joking aside, I am sorry that you have to deal with a horrible person like that. This 28 days will pass fast!!!
My Blog
I do not miss our old landlords AT ALL. The general d-baggery and sense of superiority with most of them is ridiculous. I also agree that often times, the money is not worth the stress.
But then again, if I feel a need for justice or that I've been truly wronged in a situation, I will go Nancy Drew detective on you, and come up with every bit of ammo I've got to bring you down!
But that's for special cases :-)
Sorry for the trouble.
