Whats your lunch time?

I work 9-5 for the most part, some days I work 9-6 and others 10-6.  Is it legal for my boss to tell me I cant take lunch till 2?

I am salary and her reason is that she wants us to keep our calendars open to meet with students (academic advisors).  We already have a Counselor on Duty that is available "on call" for walk ins but she wants EVERYONE to avoid the 12-1:30 slot.

  • You can lunch whenever you feel the need.

    I take mine anytime between 12 and 2.

  • Legal... I'm not sure. It would depend on both federal and state laws.

    Most jobs have some type of written or online information about things like that. You may be able to locate it. Newbies to the job, etc, are usually provided with this information.

    My friend has similar issues, but she refuses to do anything about it.

  • I don't think they legally have to give you a lunch at a certain time. I think you just have to have some sort of break if you work 8 hours.

    My lunch is 1230-130. I have a coworker that sometimes doesn't get a lunch if she watches the phones. She just eats at her desk.

  • There is no legal time that you have to have a luncy, but typically the company is required to grant you at least a 1/2 hour break for a meal every 6 hours.  That said, if you work 9-6; the 6 hour mark would fall at 3 so I think your employer is fine.  Can you use your 10 minute break to eat a snack around 11 to tide you over until lunch? I always eat lunch at about 1pm and I get an hour break; I do so to break up my day in a more appealing manner, so I can play catch up from the morning while all of my employees are out eating, then I can come back fresh at 2 and start again!

  • I found this link. It may not be too helpful. It appears that lunch times are more of a state level issue than federal.

  • It sounds like your boss has a good reason for requesting a non-traditional lunch hour. If I were you I would just snack at my desk and try to leave earlier, but I've never really been a stickler for the "lunch hour".

     I totally agree that a few of us should not take lunch during the traditional hour since that is when students are usually available.  I guess it sucks that she isnt braking any rules. 

    For some reason I thought the break time was after 4 hours of continuous work. 

  • Ha what lunch time? I eat my lunch when I have time but it's usually at my desk while I am still working! Working 8-6- Then it's off to class most nights. No break for me! And lunch breaks vary from state to state I was a manager for a while and we had a book of "break laws", I don't think that is right, google it!

    In CA (at least) for non exempt employees there are guildelines of when they have to take lunch and get there breaks (for example, break #1 has to be between hour 2 and 3 or working.)  However, you are exempt so it's a totally different ball game. 

  • as a teacher, my lunch is at 11:03.  for ten years, during the school year, i've had lunch at exactly this time.  we have 30 minutes for lunch and five minutes to get back to class.  i've often wondered what it would be like to have a lunch hour and what i'd do with all that time.
  • when ever I feel like taking one. My boss is pretty nice at letting me choose
  • I'm a teacher and have no choice.  My lunch time is 11:05 - 11:25 am. 
  • I'm a teacher, too - I work 8-4 and can either eat at 10:30 or 1:30.  I get 25 minutes.
