Legal question

DH and I have been talking lately about getting a will done. Since our wreck last week it has been on mind a lot.Especially since DH and I travel together every day. Do we need to get a lawyer to make a will or can we do it ourselves? If you had a will made about how much does it cost (you don't have to tell me the exact amount just a estimate would be good)?

  • I used to work for an estate law attorney, so I know a little about this. It usually runs about $1,500 for a simple will without major complications. I can PM you a couple of recommendations if you'd like.
  • We had a will/trust made a couple of years ago.  We went with the trust because we didn't want the people we chose as guardians for B to have to go through the court.  With a trust we were told that custody is cut and dry--no disputing from any family members/friends/whoever that may decide they want to have custody of your child and the assets that were left behind when you die.  With a will only, the guardian you chose will have to meet with/appear before a judge and if there are any other people who believe that they would be better suited to be M's guardian, they can ask the judge to consider them.  In the end the judge decides, despite your will, who will be best fit to care for your child.  (I would HOPE the judge would follow the parents' wishes, but people are shady and you never know what they'll drag out/pull up to get what they want, especially if there's life insurance or assets involved).

    I believe our will and trust cost us $900.  The lawyer is in S. OKC and I will happily give you a recommendation.  We have very detailed instructions put in place and I am very happy with how it turned out.
