Umm yeah, so we're not closing on Friday now :-( The lawyers have yet again fracked things up. I found out this afternoon about an hour after I transfered all the utilities to our name effective on Friday. Why schedule a closing if you don't have your sh!t together, wtf stupid lawyers! We're probably going to get early occupancy, and the buyer seems willing to have an agreement that if the deal falls through he will reimburse us for work we are doing on the house that needs (or is A LOT easier) to do before we move our stuff in (scrape popcorn ceiling and rip up carpet and refinish wood floors since these would help with resale anyways). The seller is also very frustrated with the lawyers, and feels terrible this is taking so long.
This whole process has been so stressful and time consuming. Part of me just wants to walk away from this whole deal, but the market is pretty limited in our price range and we are super picky.
If you want to see what a prick the seller's lawyer is, here is an excerpt of an email he sent our lawyer; "... I have tried to move haven and earth to speed up this transaction but the title problems have been labor intensive to say the least. I know you are aware of this also as I believe all the attorneys involved in this transaction, Buyer, Seller, Bank, and Title Ins. will be lucky to make minimum wage given the extraordinary amount of time this has required. This closing has been and is currently the top priority in my office as I know it is in yours. I really thought that Friday would end this hardship but several choke points have developed which can not be resolved with captaincy prior to the scheduled closing time..." (sorry the font got wonky when I c&p but the poor spelling is all his)

I'm sorry you won't be able to be in the house this weekend like you had hoped. I agree w/Xan too, the bank and seller can't possibly want to deal with this any longer than you do. But you are going to be a new homeowner and that is a big freaking deal!
I thought it was pricky because he's complaining about not making any money on this case. That's what happens when you charge a flat fee. Also this lawyer was the seller's father's lawyer and took care of the father's divorce in 2006 (and transfer of deed out of ex-wife name) and also the transfer of the property to the son in 2006 (seller). Some of the paperwork from this he just filed April of 2011.
New York State is also part of the problem. The property is owned by an LLC in Delaware (owned by the son/seller). It was handled this way so that the father could save face because he could not afford to live in the home after the divorce so the son bought the home and gave him life estate. The father passed away May 2010. The seller's siblings didn't even know that he owned the home and not their father. The title insurance lawyer wants the LLC to register in NY, the problem is that the name of the LLC is not valid in NY as it has "trust" in the name. Basically NY is one of the hardest states to do business in.
We're hoping for early occupancy this weekend so we can start getting our lives back to normal. All of our stuff is in my parents' garage and I have been staying at my parents' and DH here sometimes and at his parents' sometimes. I don't have a car I can drive because my parents got a new car so we traded in my 2004 Saturn Ion and my mom gave me her 2005 Saturn Ion but I haven't registered it yet since I'm between addresses, so the car sits in the driveway without plates. I work from home but can't focus at my parents' house as I don't have a desk to work at plus it's usually noisy and distracting here as my parents' are retired and my brother is home most of the time too (all of the house stress doesn't help with focus either).
