I agree that if her design was the basis of her business she should have done the leg work to get it legally protected against this exact situation. I still feel badly for small business owners that this happens to though.

I thought the same thing! A trademark or patent is the only way to protect yourself and if she didn't get one, then shame on her. Maybe she'll learn her lesson and get one next time.
