  • Shady business for sure.  The only problem is, if she doesn't have her design/work trademarked and was never in contact with them I can imagine it would be hard for her to prove in court and get compensation.  Regardless, I think it's really crappy for Urban Outfitters to do that.

    I agree that if her design was the basis of her business she should have done the leg work to get it legally protected against this exact situation. I still feel badly for small business owners that this happens to though.

  • Not cool. I feel bad but if it was profitable enough for her to be able to quit her full time job, you'd think she'd take the steps to protect her designs.
  • I agree with everyone.  Time to watch some Shark Tank :)  That's pretty much the first question they ask when a good product is pitched- it there a trademark/patent

    I thought the same thing!  A trademark or patent is the only way to protect yourself and if she didn't get one, then shame on her.  Maybe she'll learn her lesson and get one next time.

  • I think if she can prove that she had the concept and was selling it first, it's intellectual property infringement regardless of whether she has it trademarked or not. Our legal nesties would have to confirm that but she definitely should not take that lying down!

  • Shady for sure. If I were her, I would definitely contact a copyright/patent lawyer to see if she has any recourse.
