I'm so mad! (long)

So, on Sunday I was out shopping and was in a fender bender - totally my fault.  However, we were COMPLETELY stopped at stop light, I grabbed my water to get a sip and spilled it.  In the process of leaning over to get napkins out of my glove box, I let off the break and ROLLED into the lady in front of me.  We pull over, get out and check damage.

There were some paint chips on the bumper (which I still think were not from me).  You could see dust where my license plate touched the bumper - I wiped that off.  There was NO other damage - nothing.  I took pictures.

She says to me she doesn't think it's a big deal, her husband's a mechanic.  Of course they call it in.  That's fine, it was my fault.  Insurance lady calls DH about it and leaves a message.  I call her back twice.  Still no return call.  DH calls insurance just to verify we have accident forgiveness (we do). He finds out the an injury claim is open.  WTH?  There really is no possible way for her to have an injury.  NONE!

Why do people have to be like that?  I got hit once and didn't call it in because the only thing it damaged was my license plate holder thingy. I could have but didn't.  While I acknowledge  I was at fault, it wasn't anything a little touch up paint couldn't fix. I'm sure she'll go to some quack doctor who will sign off on her death certificate so she can milk some more money too.

  • I wish you were in NJ, she'd fail miserably. Hope Texas is tough on fraud claims.
  • That really blows. I can not stand that our society has turned into this crappy no-morals bunch of losers.

    And the insurance company will pay, so the loser lady thinks it's a victimless crime.

  • I haven't even had the chance to give my side of the story yet.  It probably won't matter.  The lady told DH she would have to get a letter from the doctor and everything if there was an injury or it could just be "my back is sore".  It just pisses me off.

    I think teaching in an inner city school has made me realize how much people take advantage of our system.  This is no exception.  I've had paper cuts worse than anything she could have gotten.

    Guess my insurance is going up.  Awesome.

  • That really stinks, I can't belive people can be like that.  I hope the accident forgiveness applies to any injury claim as well. 

    Was there a police report because that may help with the insurnace company to see there really was no way she could've been injured.

  • She'll need an actual medical report. And an MRI to show actual damage. At least she should. And if she's ever been in an accident before, your insurance company's attorney should be getting copies of those MRIs and doctors' reports too, for comparison. Photos of the cars and the police report will help you too.
  • I'd think the adjuster would be able to see her car's "damage" =/= her "injury", you know? Good luck though, all that insurance crap is no fun at all.
  • I have to completely take this lady's side. The biggest fallacy in car accidents is that low property damage = no injury. the way metal reacts to metal does not correlate to the way someone's body is affected by force. for example, you drop a carton of eggs. the carton isn't damaged, but the eggs inside are cracked.

     rear-end accidents, even at low speeds, commonly cause whiplash in neck and low back. plus you have to consider this women's age and health at the time.

    so again, i know you're not happy about the BI claim, but don't assume she's faking it. plus, maybe she just went to the dr. to get checked out, and wants her bill paid. that's perfectly reasonable.

  • I'm a plaintiff's lawyer too, but if Ash was coming from a dead stop and barely rolled into the woman's car, she's full of sh!t.

    I've been rear-ended.  More than once.  I know what the impact feels like.  There's a huge difference between the jolt of a fender bender when cars are actually driving and the bump when someone rolls into you at a light.  I know.  I've had both sorts happen to me.

    Oh, and I've never sued for bodily injury.

    At any rate, the MRIs will tell the tale.

  • That really stinks. I hate that people act like that!! Hopefully, when u tell your side of the story, theyll see that this lady is all fake. Ughh it really blows my mind.

  • I'm pretty sure this isn't a " fender bender " - I usually consider those to happen at 25 mph or less.

    It sounds like Ashleys speedometer couldn't even register her speed.

    Either way, it totally sucks.

  • Yes, I've been in both kinds of fender bender's too.  I was literally at a dead stop for at least 60 seconds before I let off the brake and rolled into her.  She was out walking around chewing on one of those plastic things that you hang a tag with on clothes.  There was no police report as we didn't feel it was needed.  There are pictures though - I have those.

    The day I picked up my wedding dress with my mom a lady hit us going 25 mph.  I definitely was sore from the seat belt and my neck.  I get that - totally.  Still didn't claim anything because I was fine a day or two later.

    She was around my age too.  I doubt I was going more than 3 mph.  We'll see what she was claiming.  It could simply be that she did say she was sore when the insurance people asked her and that's fine.
