    Wow! That's really fast. All of the attorneys they were interviewing kept saying that first degree murder had absolutely not been proven...I hope that's not why they're back so fast.

    I don't think that murder was proven, but I think the circumstantial evidence supports it. Especially after Madisen's clarification about the 1st degree regarding children. I hope that's the case... but I feel like it's going to be 2nd degree.

    Pretty much ditto everything you just said. I'm just afraid with all of the crap in this case that they might just default to 2nd degree.

    Also, they said this morning that women for the most part seem more convinced of her guilt and are appalled that she could murder her own child, and the jury is 7 women to 5 men.

    Does anyone know, to be 1st degree murder, does it have to be unanimous?

    Yes, I think so. I could be wrong...but I'm pretty sure.

    ETA: I found this:

    There are 2 ways to get to the first degree murder: premeditated AND/OR felony murder, and the jury does not have to be unanimous in either. A combination of 12 votes in either of these will do it.

    Although, you know there has to be a least a few people on that jury that thinks she's guilty as sin. You'd think they would have to deliberate longer to convince those people that it wasn't 1st degree. Maybe the quick decision making is a good thing?

    All counts have to be unanimous.  What doesn't have to be unanimous is the reason for 1st degree (premeditated or felony). Not that it matters in this case anymore.
